Warning for comet customers

My elderly father purchased a Humax digibox from Comet last week which cost £130. He only opened the tape seal on the box when I arrived & informed him it was not the right product for what he was wanting it for. We took it back to the shop the very next day & Comet said they would have to take 10% off the price paid as the box seal had been opened (a piece of sticky tape). So the item would need repackaging, they also said the only way we could get a full refund would be if we purchased something else of same value or more at Comet. I cannot believe they are allowed to do this but it is in the small print on a leaflet they gave me. I just wanted to warn people as with xmas coming up they will be making a fortune from unwanted gifts etc which may have to be returned. I have emailed a complaint to various emails that I have found on the internet for Comet but have received no acknowledgement from them whatsoever.:mad:

  • You have absolutely no right of refund if goods are not faulty.

    A lot of computer shops charge a restocking fee of 10 or 20%.

    And although you say that he only undid a bit of tape, that box now needs to be fully opened and rechecked before it goes back on sale because I would be pretty narked if I bought it and discovered your father had scratched it, or swapped out the remote control for a broken one he had at home. (Not suggesting for a minute that your father would, but I know some people would, and the shop has no way of telling.)
  • First mistake normally would have been buying from Comet but I think that is the second mistake in this case.

    You have no statutory rights to return unwanted items only faulty/ defective ones or ones that have been miss sold. If you have unwanted presents or make a mistake and buy the wrong thing you have only the stores own returns policy and goodwill to rely on.

    Much as I detest Comet, I do feel you are being unreasonable.

    Comet have no legal obligation to take back goods unless faulty, and they do give you a leaflet with each purchase outlining their returns policy.

    Would you of been happy to by second hand goods at full price?

    I'm guessing the answer is no... so what would you expect them to do with them?

  • OP - what did your father buy, and what did he really need to buy? If your father accurately described his requirements to a COMET sales assistant, who then recommended a product that was not suitable, you may have a valid claim for a refund.
