please help with lap top problem

hi. I bought a lap top from PX World 10 months ago and within 5 months it just stopped working, took it back and they said they were sending it back for repair, i told them i wasn't happy with that and would like a replacement they did replace it and now exactly 5 months later the new one has now broken, i took it back yesterday and the manager said we'll send it back for repair, again i said i don't want it repairing i would like a new one and not the same one as i have lost all faith in the make and model or my money back, they now say its company policy to repair as thats the manufacturers policy and they don't have to exchange it or give me a refund, even when i pointed out that they exchanged the first one so that the policy wasn't set in stone he just said well i'm not exchanging it. When i quoted fit for purpose they say i have to get a report done to prove this, but i thought if it was less than six months old the onus was on them. Can someone help me know my rights as i need to feel confident if i need to return for a second time

    After a reasonable period of time (which Dixons Group Classify as 28 days) they are entitled to remedy the situation by either repairing the item, replacing the item or refunding (may be partial). They are well within their rights to attempt a repair first, the fact that you got a replacement the first time was goodwill only, and unless they explicitly stated when they exchanged it that they would exchange it again if it went faulty, you would have no recourse.


    Sorry, but under the SoGA once you're outside the reasonable timeframe to inspect the goods and return if faulty the retailer can choose what to offer.

    Your 6 months fit for purpose starts from the original purchase date, not from the date they replaced your first laptop (which btw I am VERY surprised they did, not in any way are they or were they obliged to) - so if you dont let them repair it youl will need to have an independent inspection to claim under SoGA.

    I would not hang about with letting them repair it - you only have 2 months warranty left on this laptop - get them to repair it for you quickly so that you still have warranty left when you get it back.
