Should DLA renewal decisions take immediate effect

My Brothers DLA has been increased on renewal. But the date the increase take's place is the date his current DLA claim finish's. I'm aware if they stop or reduce a DLA claim on renewal its takes immediate effect. I thought it was the same if the claim was increased.

    no, it's from the date the old claim finishes.

    jf jt was a 'change of circunstances', then it would take effect from the date the forms were requested.
    if your brother chose not to put in a COS and wait for the renewel, then the decision is correct

  • When mine was due for renewal in April this year, I sent the form back about 11 weeks before that, the DM phoned me to ask a few questions about how my hands had got worse and when did I think that change had happened, ( it was in November 10) so the new award of LRC started 3 months from then (Feb this year) so it doesn't always go from when the old award ends..As long as you had that change for 3 months mine stated 2 months before the end of my old award ( just HRM)

    Hope that makes sense ( too many meds lol)

    That's what I was led to believe. In my brothers case, his condition degraded some 18 months prior to receiving the renewal form (and was stated such on the form ). So he expected the new rate to apply from the date on his DLA form. His renewal is due in Jan 2012 and that's when the new rates will apply.
