    I received notification from FOS today, that they have asked Santander for information in reply to my complaint, when they get that it will be in the hands of an adjudicator. The wait continues.........

    Anyone have any idea how to get hold of my account number for a Cahoot Flexible loan ? It's been 4 years since my account closed and I'm not sure I could lay my hands on it.
    This flexible loan helped get me into substantial debt (I made a pretty good effort myself) and I get to the stage I was paying off £,00s a month and not touching the balance.

    Have you an account reference on your bank statements ?

    Not that I can find at the mo, my online banking doesn't seem to go that far back. I wonder if I can go to Barclays and ask them to look for me.........

    Hi, try a credit reference agency, Noddle is free. It should show the account number, even if it doesn't just write to Santander with your address etc and they will have it.
  • since the bulk reject letters sent out a few months back....has anyone received a judgement good or bad from the FOS yet? I would have thought a few of the first complaints would be at resolution by now?

    My last update is that it's now with an adjudicator, so god knows how long now! I sent my FOS complaint off at the beginning of April.
  • Well, I replied to Santander's initial knock-back letter, asking for a full explanation of which clause they were using to validate the rise in the interest rate. I'd gone through each one in detail, explaining in each case why I thought the clause was not valid in this case. The only one I couldn't argue against was the "any reason that is valid" clause. Guess what, this is the clause they came back and said justified their raise. So, they are basing their entire justification on the "we can do what we like" arguement. I've emailed them and they have confirmed that this is indeed their final response and that they are refusing to detail the valid reason. I want to include a written confirmation that they refuse to co-operate in my FOS complaint.

    Just received the standard knock back letter and copy of terms and conditions, can I complain to FSO without statements as haven't done an SAR yet?
    Second and final LBM 01/01/11 Nearly got there but fell of wagon. HAVE to do it this time :mad:

    This should be covered under the Unfair Contract Terms Act 1999 This link explains it a bit more...

    Cheshire Mortgage Corporation Limited has agreed to provide an undertaking in relation to the interest rate variation terms contained in its mortgage contracts. The term allowed the firm to vary the interest rate on the mortgage for any reason and at any time. We thought the term was too wide and was unfair because the firm’s power was unrestricted. We believe these terms should only have allowed the firm to vary the interest for a valid reason which is set out in the contract. Without valid reasons set out in the contract, we believe the terms are unfair.
