Where do i stand

Wonder if anyone can advise.
I ordered on line with M&S,done this many times with no problems however not this time.
I paid for next day delivery but had an e-mail saying that due to error the goods would'nt be available till 5 or so days later.
I have waited all week for my delivery however nothing has arrived.
On checking online I saw that my parcel had according to them been delivered.
Rang M&S earlier this evening and they checked up with the delivery people and was told that the parcel had been left on my doorstep two days ago.
I was in all that day too but never heard the delivery man,he never left a card either.
I asked for a refund but M&S said they have to look into it.
What I want to know is can they make me liable,when its not my fault.

  • No they can't make you liable if you haven't received it. I'm very surprised that they're admitting to leaving it on the doorstep though. Talk about shooting yourself in the foot! They may try and allege that you received it but stand firm saying that you didn't and they don't have a leg to stand on.

    We had a similar problem where a company was adamant that a parcel had been delivered. The driver specifically remembered putting it through our front door because it was red. Uh no, our front door is white!

    Was this Yodel/Home Delivery Network? I don't know why M&S continues to use them (other than they must have supplied the lowest quote - and what does that say for how M&S regard their customers?)

    They use them because they are cheap

    And Yodel only leave parcels when they are allowed to do so, M+S get a cheaper rate for 1 time delivery without signature.

    Although they should be left in a safe place not a doorstep in full view

    I was trying to assist the OP.

    The M&S website messaging system is very hit and miss - often one doesn't get a reply despite it saying "Your message has been sent. We will be in touch etc".

    The one I gave is the one M&S supplied to me. It goes to the Chairman's Office, is acknowledged immediately and is generally replied to within a day.

    Marcus, that is a valid Marks and Spencers e-mail address it is on their website.

    Home delivery network is a nightmare,they leave packages for us in our porch in full view of the street (glass door) with the delivery card on top of the parcel!

    WHO is Marcus. that site is the site that TS etc. will inform you to look for the CEO of major companies. the only issue is are the details up to date
