Need some advice Guys ! Facts below to consider for us please !
Wife on sick leave from NHS hospital ( domestic ) with COPD & arhtritis , we do not think she will be going back to her job as its getting too much for her condition which will only worsen !
I get Pension Credit as wife is P/T less than 16 hours a week !
Will be submitting monthly pay slips to DWP each month for top up as wifes wage is very good , 1 &1/2 on saturdays and double time sundays , SSP less than 1/2 her monthly total .
So now we come to the nub ..................
Would o/h be better off handing in her notice and me claiming for both of us on my Pension Credit ?
Should o/h stay on sick leave and wait for dismissal , as will come eventually ?
o/h will claim for DLA soon , would her notice affect the DWP or DLA decisions in any way ?
If it helps o/h has been in this job for over 10 years now and has an excellent work record until the onset of this illness !
Hope you can advize Guys
Regards

DLA is irrelevant to any other benefits, she could be working and still get it if she has care and/or mobility needs. So there is nothing to stop her claiming now, whether she works or not. Although if she then receives DLA, it might act as a gateway entitlement to other things.
The rest, I have absolutely no idea.I could dream to wide extremes, I could do or die: I could yawn and be withdrawn and watch the world go by.Yup you are officially Rock n Roll

Is your wife employed by the NHS or by a contractor?
Have you looked at your wife's contract to see what the policy is regarding sick leave and capability?
Often contracts state that if you are unable to do your job due to long term ill health you can be medically retired which means you can start receiving part of your pension early. If she resigned then this would be irrelevant and she wouldn't be entitled to anything.
It is worth checking her contract and staff handbook to see whether she is entitled to anything if she is dismissed due to ill health before doing anything else.0 -
Just thought i would update on this ..............
office staff where in touch with o/h to clarify her position regarding SSP and her wages , seems because of her length of service (11 yrs ) and excellent attendance record , only 4 days sick leave in that period , she is entitled to Full pay for 6 months and then will go onto ssp after that time !
Has had contact from Occupational Health and also from Right to Work department , all with good advice , Excellent !
DLA advice takes place next week with a local DIAL office
So looks like we will be able to soldier on a bit longer !
