6 year rule and retailer / credit cards...please help

Wondered if anyone could confirm my rights. I bought a TV/DVD combi 2.5yrs ago and the DVD no longer works. I took it back to Currys who agreed with me and upon mentioning the 6yr rule they have since called to offer me £65 (it was £155 originally) or I can keep the TV and no refund but asked them to repair but they say they will not repair as uneconomical for them to do so.

I said that was not my problem (but nicely) so should have a repair or full refund and they won't budge.
Do you know if they should improve on this offer as they should offer to repair and if not then a full replacement / refund should be given?

Also, as I used my credit card and based on the offer above, is there anything in addition they could do as Barclaycard are saying I don't as I do not pay for card protection but she was not understanding my point on the law I think.

any help much appreciated.

    Since you have had 2.5 years use out of it I think the offer is pretty fair, I dont think a full refund is appropriate after such a long time.

    Try getting them to up their offer if you buy anothe one from them.

    The 6 year rule is not set in stone,
    make the most of it, we are only here for the weekend.

    your lucky there not getting you to get a fault report produced on the item.

    £65 is a good offer for a TV that old. I wouldn't really expect a cheap TV to last 6 years anyway.

    yep fair offer - Im astonished you think you are entitled to a full refund after 30 months use - the TV itself still works in any case, its only the additional functionality of the DVD.
  • I thought it seemed fair tbh but something I read made me think that if they did not offer to repair it then I had a better leg to stand on. It is only a bedroom TV but was reduced from over £200.

    Also, they did say that I had to prove the fault. I therefore asked how and they said I had to pay for an engineer to come out to prove it was a manufacturers fault. I therefore said if they only needed proof then I would take it in to my local store.

    The manager in the store said that this was not possible and had to get an engineer so I informed him that that was not the case and he called head office who confirmed to him that as long as he could confirm the DVD player did not work then that would be adequate and no need for an engineer. Hope that may help someone.

    A Partial refund on my calculations are
    £155 divide by 2 = £77.5

    Now depending where you live it'll either be 5 years SoGA or 6 years.

    The fact is they can take deprecation of TV's into account and also the cost of the TV and the brand and a whole host of other things to devalue the TV.

    So the fact their offer is £10 off the "Partial refund due to use" is actually very, very fair of them. You could also just ask them to give you a free DVD player , but they are under no obligation to do so.


    The've decided what remedy to provide you (A Repair, A partial refund, A exchange are the options, and the retailer gets to choose which is most cost efficient to them), If you decide not to take it, there is nothing you or any legal action can do for you.



    *Edit* as far as the proving bit goes, for small items they will tell you to take it into the store and the KnowHow guys will look at it, phone the number and give the case ID you have and the phone chappies usually ask "Does It Work?" and "Does It Look In Good Nick?" if everything checks out, you leave the item with them, and they just recycle it.

    If you take the £65 you could just buy a £20 dvd player and have a night out with the rest.:D

    This assumes that it would be reasonable to expect an item to last 6 years. For a £155 TV/DVD (at prices 2 years ago), I probably wouldn't expect it to last 6 years. 4, maybe 5 in my opinion.

    A £155 quid TV/DVD combo, personally i'd think myself lucky to still have it after 3-4 yrs.

    6 years is the time period you can bring a claim agains them op, doesn't mean products have to last 6 years or if they break within 6 years you have a valid case.

    Actually, it is the buyer's choice which to go for. The trader can then refuse in certain circumstances, for eg if the buyers choice is more disproportionately more expensive than another option. A pedantic point perhaps, but an important one as it is not simply about which is cheapest for the retailer.
