No, they don't. Not until they've taken your money which happens at the point of despatch.

Indeed, they definitly don't (and probably won't) honour this, and as stated above (and i mentioned earlier) they don't take the money out of your bank until dispatch.

So at the end of the day you'll either get it and be very happy, or they'll cancel it and you'll have lost nothing and won't be able to complain about anything.

Bargain finished anyway, back to £99.99.

    They are going through the stage of cancelling all the orders;
    Dear Customer,

We are writing to you with regards to your recent order placed via https://www.hmv.co.uk, for the following item:

    Cat.No: 3711505413 Barcode: 5037115054135
    Artist: CARRY ON
Title : CARRY ON COLLECTION: 18DVD: BOX SET

Unfortunately, due to a system error, this item appeared for a short time on the web site at an incorrect price of £9.99. The correct retail price for the set is £99.99.

As stated on the Terms & Conditions of the HMV web site, HMV are entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on our web site.

We have therefore cancelled your order for this item.

Please accept my apologies for any disappointment caused.

    Regards

    Customer Service

Yeah, a shame, but can have no complaints with that. They've not charged for it, held their hands up to the error, and are well within their rights.

Good to see this rather than another WHSmith fiasco!

Fingers crossed. Hope this doesn't turn into a 20 page discussion when they cancel all the orders and everyone starts banging on about legal rights and contract breaking blah blah blah! What a carry on...

    Good spot though. Well done.

you're very quick to criticise but missed the whole point of that thread - the whole point was that they took the money!

incidentally HMV have phrased it badly:
"As stated on the Terms & Conditions of the HMV web site, HMV are entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on our web site."

they really shouldn't phrase it as a withdrawl from a contract but rather refusing to accept our offers of purchase. Why won't companies actually pay any attention to the law of contract!

I think they have themselves well covered on this one:

"The contract will not be formed until HMV charges your credit card at the point of despatch of the goods"

and as they aren't in stock there will be plenty of time to realise it was a mistake.

of course from the ebuyer case we know that a contract isn't worth anything, although i wouldn't class hmv in the same league as ebuyer.

It's always a system error, never user input error or the fact that some companies have no safe guard checks on prices put live on websites. The system error reason is given as a get out clause.

If a real system error occured the software developers should be charged for any losses due to this error (if it was their fault of course, and not a poor specification by the company) - having learnt all about software contracts in my computer science degree i can see in real life you can mess software up as much as you want and just blame anything on system error :)
