CapQuest letter, two years on!?

Hi Everyone,
i just received a shocking letter this morning over an unpaid ammount of £52.05 from two years ago.
Two years ago i changed mobile phone supplier from Orange to O2 at the end of my 18 month orange contract two years ago. Everything went through smoothly and i heard nothing from Orange. I lived at he same house for over a year, and then moved to my new house in January this year.
Just this morning, ive received a letter from CapQuest debt recovery saying that i owe £52.05 and they have given me a default on my otherwise perfect credit rating.
I've always paid the money i owe straight away, if i knew i owed any money at all i would have paid. Im very upset and wondering what to do now, do i write to Orange? Or do i write to Capquest?
Thank you for any help/advice

Personally, Id write to Capquest stating you changed phone suppliers at the end of a contrat, and have received no bill/statement from Orange since that pint - and ask for proof of the debt.
id also state that if the debt was genuine, then you would of course pay the debt - and ask in this case for the default to be removed from your history as you have/had no knowledge of the debt.
it may be that you were required to give 30 days notice - in writing - when changing contracts and this didnt happen hence the charge. That said it could be an error and in fact you dont owe the money. Even if you DID owe the money you have received no bill/statement asking for payment either so?
You can also request the Credit report agencies to register you own comment against the default if it isnt removed, basically stating you had no knowledge of the debt, and had no contact from the creditors requesting payment before the default was raised - also the debt was cleared as soon as it became apparent.0 -
Thank you paul for your reply

i will write them a letter now covering all your points. Its a real shock to recieve a letter like this, i thought at first it was a mobile phone contract fraud in my name!
Hope i can work out whats happened, and why its taken them two years to get in touch with me, they could have just phoned the mobile number! haha0 -
Hi all,
my letter was ignored by CapQuest. All i got in return was an almost empty letter, with a box in the middle saying:
"We can confirm that the last payment on this account was on 20.10.2009 for £33.71. Please contact us to make an arrangement."
They ignored my questions and what i said in the letter, is this normal? Im going to write to them again now and spell out the questions clearer.0 -
Hi everyone,
has anyone else had experience with CapQuest and been equally as frustrated? Every letter i send to them is completely ignored, with a brief letter coming back confirming the ammount.
I dont know who to turn to now, they have wrote to me saying that I have 14 days to pay or it will go to County Court.
Please advise me what to do if anyone has any ideas, they have not answered any of my questions.
Im going to print all three letters now, photograph them and post to them recorded in todays post. Im also goingto try addressing the letter to the management to see if that helps.0 -
Hi.
I had the exact same letter just over a week ago.
Mine was for a T-Mobile phone bill. I got into trouble paying it. I owed just over £100. They asked me to pay £70 and that would be it.
I paid it in November 2008.
Yet they are now saying I owe them money!
I had a letter template given to me on here which I sent them.
I am awaiting their response.0 -
thanks michelle,
glad to hear im not the only one!
Did they say you had a default for this too? Hoping i get an achnowledgement that they have actually read my letter this time, i printed both previous letters sent to them, photographed them, put them in a sealed envelope and posted to them recorded!

...Dear moronic idiots,
Please find enclosed copies of all my previous correspondence.
I'd be grateful if you could pull yourselves away from your crayons and lego and actually find the time to both read and understand the contents.
Once you have carried out a thorough search of your offices and found someone that can read, please feel free to supply me with copies of the documentation that leads you to believe you have a legitimate right to persue this alleged debt.
In the meantime, rest assured that I will be sending copies of both parties correspondence to the OFT and lodging a formal complaint about your inept attitude.
For the avoidance of doubt and that you fully understand my position and request, please find enclosed a copy of the above that has been done in big letters using crayons, with accompanying pictures.Happiness, is a Kebab called Doner.....:heart2::heart2:0 -
My fiance had the same problem when migrating from Orange to O2 about 3 years ago. We gave Orange a months notice, paid the final direct debit and moved to O2. Last spring we got a letter to say that £50 (or so) was owed when we were sure that we had paid everything. Turned out that the payments each month cover the phone from 2 months prior. Which meant that our last payment to Orange was for the previous month's bill. The current month's bill was still outstanding.
I suspect this has happened to you, I'm now worried that they may have left a default on my fiances file - not good since we are saving up for a house and mortgage next year.0 -

Thanks MrWillyWonka,
I would check that definately, id get a credit check sorted.
Im still having trouble getting throguh to CapQuest. They are receiving my letters, but each one is being ignored. I sent them all the info they ask for. im now on my fifth letter to them.
Is OFT the governing body to write to about them?
This is the letter ive just written which im just about to go and post to them recorded first class (again), which is just a version of thechippy's post above i think
jamesfawcett.co.uk/capquestletter.pdf sorry it wouldnt let me post links
I dont mind paying the money if i owe it thats no problem, but id like it if they could explain why, and why Orange never sent me a bill (or even called the phone number, it was the same mobile number i still have now!!!) I don't want a default on my credit rating  and CapQuest need reporting for being this bad.0
