Statutory Sick Pay

Hi
I am suffering from a neurological disease which is preventing me from attending work. I've been absent from work since the middle of September. At the end of September I was paid my normal wage. However, last week I received a lette stating that I am not entitled to sick pay. Obviously I thought then that I would receive statutory sick pay for thsi period but my employer has deducted this sick pay today as I was overpayed last month apparently.
If the employer is paying this money on behalf of the government, then do they have the right to deduct anything?
Any advice would be appreciated

You need to earn over £102 weekly in the 8 weeks before you went sick to get SSP, if you did not your employer should give you a form called an SSP1 this is the start of your claim for Employment Support Allowance0

If your Employer has overpaid you in September, say becasue you went sick mid Month but had already been paid for all of September, they can recover the overpayment but not from SSP as this is the minimum payment you must receive. Unless as previous poster has stated you do not qualify for SSP in which case they should have sent you an SSP1 detailing why. You can download and print your own SSP1 from the internet.0
