I've got a query regarding Mobile Phone Insurance. Does cancelling your policy stop you from making a claim after the cancellation for an event that occurred pre-cancellation?
I'll explain.
I had mobile phone insurance with o2, one day i dropped my phone and it broke, I checked my insurance policy and it said I could claim for repair so long as I informed them within 14 days. As I needed a phone, and I was out of contract anyway, I went into an o2 shop and upgraded my phone and then proceeded to ring o2 to make an insurance claim. By doing things in this order I made a grave error.
I was told that by upgrading my phone my old policy had been replaced by a new one and so the old one had been cancelled. Fair enough,
They also pointed that I could only make a claim on the old policy if it was still running (which by upgrading it wasnt). They therefore rejected my claim.
This seems a little bit odd and very harsh. I can understand that by upgrading my phone, my old policy had been cancelled, but why can I not make a claim for an event that took place during an insured period within the timeframe outlined in their terms and conditions (14 days).
I have reviewed the Terms and conditions of my insurance rigorously and I simply cannot see anything which says that my insurance policy has to still be active for me to make a claim. I spoke to someone at o2 and they said 'that it didn't need to be written in the contract as it was common sense that I couldn't claim once my insurance policy had been cancelled'
Is it really common sense? If I've paid for cover up to say 30 September and I cancel my insurance policy on 1 October, why can't I claim for an event that took place on 29 September if all it says in my agreement is that the claim must take place within 14 days.
Yours confused,

Appeal their decision (in writing).
If they won't budge, then escalate the matter along their complaints procedure which will be set out in the policy.
If that fails, you can then refer the matter to the FOS.0 -
Thanks. You are seriously helpful!0
