non fault claim premium increase

3 1/2 years ago i had a serious non fault accident, the third partys side paid up and im still waiting for a personal claim to go through,
today i started ringing round for this years taxi cover, my current broker has increased from 840 to 1100 same company,
when asking about claims in last 5 years i have to report my ongoing claim, when i tell them £9000 paid out for car and expenses so far but still have to settle, they tut tut. im being quoted around the 1100 mark but when i mention what my legal expert has said ref the size of my claim ( only given rough idea) but they must have previous cases to go on im told it could affect the premium quite a bit.
WHY, and if so surely this is an expense i can claim against. how do i go about getting 2 quotes one for "no claim in 5 years" and " a claim made"
do i just lie about the first then come clean, are quotes logged on the insurers database?

There is evidence from posts in this forum that quotes do get logged, and stored.
When you apply for a quote online you declare the info you have given is true.0 -

Quentin, if i was going to get 2 quotes i would do in one call, maybe something like OH did i mention i had a non fault and would that make any difference, so long as i get 2 quotes like for like with the accident difference thats all i need.
Lisyloo, i will speak to my solicitor when i know if there is a difference and report back.

As far as i knew:
If the other side paid up in relation to the car (repaired/replaced), etc, and is non-fault, that will be recorded as settled....
PI claim is not related. I could be a passenger in a car, and some plum hits that car i am in, i could do a PI claim against the plum which has zero affect on me , whether i have car insurance or not...0 -

Its a bit of a ridiculous situation but they can load your premium even if non fault as you are statistically more likely to be involved in a future accident. Guilty until proven innocent.
It is ridiculous as statistics can be shown to prove anything. Such as most sexual assaults are committed by males so all males should be tagged just in case they have the urge to commit the offence.
It also does not take into account what happened in the non-fault claim. Such as you were legally parked in a marked bay and a driver ploughed into you when you were not in the car to;
You were driving on the wrong side of the road forcing an oncoming driver onto your side which you then swerved into and were found not at fault due to lack of witnesses etc. as the other driver was found to be on the 'wrong side of the road'.
There is no distinction and you are classed as higher risk. Even if a meteorite fell on your parked car which is clearly non-fault it may effect your premium as it is a non-fault claim.

Insurers have clearly introduced a "Lucky Factor" to the risk criteria.
The more unlucky you are the more likely you are to have an accident so they jack up your premium.Mr Straw described whiplash as "not so much an injury, more a profitable invention of the human imagination—undiagnosable except by third-rate doctors in the pay of the claims management companies or personal injury lawyers"0 -
Tell your broker to work harder, would be my advice0

For example I live down a long private road which is a dead end. Very few people come down here (cost it's a dead end) so any cars parked here are unlikely to get hit.
That's not the same as luck, that's a factor of the type of road I live on.
To a degree you could say that everyone carries a level of basic risk because most people go to supermarkets/cinemas/shopping now and again.
But beyond that the places people drive and park vary considerable and it's not down to luck.
For example parking at work in a private car park where people only drive twice a day, is very different to parking at a railway station where traffic comes and goes ALL the time.
I onyl believe in random chance a little bit, the rest it driven by behaviour, location etc.0
