Fir for purpose

Hi,
Im being a bit of a chancer as i pay a fortune for my contact and begrudge having to pay for a phone...
Ive had my blackberry around 18 months and the O key has stopped working.
I have NEVER broken a phone in my life (over 10 years of having phones). I signed upto a 2 year contract and so im 3 months away from being able to replace it.
Could i argue that its not fit for purpose as you would expect it to last the length of the contract?
I cant be bothered calling the network to argue it unless i have a strong case as i know they will just real off what they were told in training.
If not then i suppose i will just have to fork out for a new one.

Fit for purpose isn't really the issue, but you could argue that your particular model wasn't of reasonable quality. However, keys not working on a phone after 18 months is highly likely to be due to use/wear and tear/damage etc. rather than an inherent fault and I doubt you'd be able to claim under the SOGA.

To be honest, im happy enough with blackberry. 3 years ive been with them and they have spent 3 days where i couldnt access bbm or email. I still had my phone and text, anything that was urgent i was always contactable by phone.
My wifi worked too, so i could pop into costa or mcdonalds to check up on any important emails.
Im thinking it would be wear and tear but you would expect it to last 2 years, i dont mistreat my phone. Why not call your network and discuss with them first?
You never know, they may be willing to upgrade you early. They may also offer to repair the phone free.

They're not rubbish, Orange let you upgrade with 3 months of your contract left and the OP can't swap networks because.... (drum roll.......) they have 6 months of their contract left.0

When my phone stopped working Orange happily replaced it with the same make and model. I just went into a branch and they sent me a new phone the next day.0

Ring and explain the situation again, politely mention the fact that the phone should last the length of the contract. If they do not move ask for a quote to cancel your contract, they may then transfer you to someone who is more prepared to help. Of course you do not have to cancel just make out you are prepared to.
If that fails you could write to them and let them know that you are not happy with their service and you will be moving to another provider when you can.0
