Is this Legal??

I had an account with SPower for G&E. The contract expired in December 06. I went on line through one of the many sites and signed up for Online Energy 2 because the rates and discount were OK etc. I failed to advise them that I was an existing customer whose contract had recently expired (Fixed price basis).
I received an e-mail saying that my application had been accepted and that I would be hearing from SP in due course to arrange setting up the account etc. I telephoned them today to ascertain the status of my new account and was told , 'Sorry' that account is for new customers only. On further enquiry it seems that the associated discount for the Online Energy 2 account is greater than the ordinary Online account (Premier). As you can imagine I wasn't too pleased at being treated this way and am wondering if Utility companies can legally discriminate against their existing customer base by offering new deals with better discounts etc to new customers only.
Your comments appreciated.

Npower do exactly the same with their sol tariffs. It's not illegal. Many banks do exactly the same. If you're not happy, switch0
