They have called the charges 'penalties/fines' when they are clearly nothing of the sort and are a 'benefit' to PPCs upon which VAT is payable
NO..no..no...they clearly ARE penalties which is why they are not enforceable ...however they are not the type of penalty that is VAT exempt as they are levied by private companies which have no statutory basis to issue penalties. Statutory penalties that are provided for in law and are charged by official government (central or local) departments/agencies are VAT exempt.
The key difference is that the PPC penalties although they act as such are actually there for the purpose of private commercial profit.(and nothing else)
e.g. Excel making £600,000 a year from ONE car park ....so at £100 a ticket that would be 6000 "contraventions" a year and yet they are there to solve problem parking .??... how is anyone actually buying this bullpoo ??????!!!!!! :mad:0 -
I have e-mailed the Home Office and asked them to confirm the name and contact details for the minister that signed the document and their and their office contact details, as well as the originator/author of the original report/document.
I should get a reply with the next couple of days... once we have their details, we can start and put them straight on a few things!0 -

None, surely. They have been hoodwinked by the BPA.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Keeping politics out of it, they clearly believe that these charges are in fact fair. The majority of PPC charges are £60 -£80 which is of the same scale as Council charges. Clearly HMG believe if you can be fined £60 for parking wrongly on a road or council car park why not a private one ?
Be assured if there was any way they thought they could get away with it they would make these charges statutory.
However even these idiots realise they can't have privateers issuing actual "fines".
Politically speaking it's simple, this is a case of :-
The "right" of big business /shareholders/landowners to profit from the "little" man who is ignorant of his rights ...now what sort of Political party would endorse such a "I'm alright,screw you " policy?
Does the name Margaret Thatcher ring a bell ?
PS It doesn't assist them half as much as they seem to think it does, all the usual defence arguments remain intact apart from I was not driving .
As such it is important that the truth is published which is -keepers can IGNORE their idle threats also.0 -
Right, got an e-mail back from the Home Office, saying that the document, as I suspected, originated from the DfT. They have passed on my enquiry and I should get a reply from the DfT within 48 hours.
As soon as I get the information, I will post it up.0 -

I was clamped yesterday by Parking Direct Ltd - It turns out that the road that I was parked in was private property (Although it was a road leading off of a main road roundabout and it looked just like a normal road onto an industrial estate - tarmacs, kerbs, blah blah blah ) however it was private I did not notice the white cardboard cable tied signs and was clamped - £125 clamping £250 cancellation fee for tow and 2.8% for paying by credit cared. Total £385.50
I requested proof that a towing vehicle had been requested and proof of cancellation but this was not available - I paid by credit card - I would like to know if I challenge this part of the 'fine' and request my card to claim this back, where I would stand???0 -
