Returning faulty clothing - Tesco success!

Hi, I bought a cardigan in Tesco around 6 weeks ago, have worn it 3 or 4 times, been through the wash the same amount of times, the seam is coming apart on one arm, it has started randomly about 1" from the cuff. I haven't caught it on anything, or had the scissors to it or anything silly! It was only a small hole this morning, so I thought I'd put up and mend it tonight, however, it is working itself out more and more through the day, as is my dismay at such a shoddy product!

Would I have any right to return the cardigan to a local Tesco (not the one I bought it from)? Also, I would not want to accept a like-for-like exhange, as I've no confidence in this particular design, can I ask for either gift vouchers, or exchange for another similar item of clothing? The reason I am not going to the Tesco I bought it from is because I bought it at home, and am in work, with a rapidly unravelling sleeve and would like to have something suitable to wear within the next couple of hours. Thanks in advance for any advice.

UPDATE: A lovely lady from Tesco emailed to ask my postal address, as they will be sending a £10 giftcard. She was very apologetic, and also said that my email would be forwarded to the store manager so that all staff could be refreshed on the outline of the Sale of Goods Act :T:T
I will be printing out the email from customer services and taking it to Tesco at my next opportunity to secure my refund/replacement also. :T

    You do not have to return it to the same store. (Since it is Tesco/a retail chain).

    The item is faulty, so you can return it under SoGA (Sale of Goods Act). Also, as it is less then 6 months old, retailer must prove the fault was caused by the consumer otherwise it is automatically deemed inherent (present at the point of sale). Retailer can offer a repair, replacement (or exchange) or refund - their choice, but consumer can state their preference.

    If you have the receipt (or some other proof of payment) this makes things a lot easier.

    Summary - yes you can return it, and if you suggest gift vouchers they'll probably accept this remedy. :)
  • Thanks, I did call to the store closeby, but they wouldn't accept it because they had never stocked that item, I said I understood that, but regardless I bought the item from Tesco the company, not Tesco myhometown, and while I did not have a receipt, I did have my bank statement showing the purchase, I even offered to accept a refund of the reduced price it is currently selling at, purely because it is not of any use to me now with one normal sleeve and one flappy one! She said my bank statement wouldn't do as I purchased other items along with the cardigan, I said I didn't want to appear to be "having a go" but I was sure my statutory rights said that as the item was not fit for purpose and did not last a reasonable length of time, a receipt was not necessarily needed. The clothing manager stood there gormless, as I was on a lunch break on restricted time I told her to forget about it and left.

    I will be sending a more concise version of events to Tesco Customer Services, advising that they retrain staff in statutory rights versus making things up as they sound about right. Pah! Have rung customer services to confirm the bank statement will do, and suppose I will trod along to my local store tonight for round two, and hope the locals are a bit more receptive!

    While I do kind of agree you bought from tesco, there are actually several different companies underneath the tesco umbrella. And i believe they're registered as such too. I remember seeing something on tv about it years ago. Something like intelligent accounting to save money on tax. Its not just tesco, its tesco metro, tesco superstore, tesco express etc.

  • Yeah, they were both Tesco Extras. I have sent an email to Tesco Customer Services and will keep hold of the cardie until I hear something from them.

    What I wasn't sure of, is I did pay by Visa debit card, the total transaction was over £100, can I request a partial chargeback?
