My wife received a parking notice letter from Excel for an 'offence' which was committed by a 3rd party who had borrowed her car with her consent.

She has now received letters from a Debt collection company (Roxburghe) and we are now being bombarded with daily phone calls from Roxburghe and now Graham White Solicitors.

We responded to the original letters with a letter confirming that my wife was not driving and asking them to stop writing as it was not her problem.

Over the last week we have had calls to our unlisted home phone number asking to speak to my wife. Usually she is at work so I just tell them not to ring back as I consider this harrassment. They rang yesterday when she was in but I refused to hand the phone over and accused them of harrassment.

Today the solicitor's office rang and threatened me with court action against my wife if we didn't pay up or advise them of the identity of the actual driver. I told them that I would see them in court.

Do they have any chance of taking action against my wife and winning?

First of all, no 'offence' was 'committed' even if you/your wife HAD been driving. I do hope you would still have ignored them.

And did you know that the OfT were 'minded to revoke' Roxburghe's licence (that includes Graham White as it's just a trading name of Roxburghe, not a Solicitor's office). Now, to stop those phone calls. Have some wording ready which your wife should be the one to deliver:

'the alleged debt is DENIED and this phone number does not even belong to the car driver. As such you must now stop contacting us completely and return the file to the originating scammer' (use that word if you want, or be more polite).

'Your contact is harassment and will be reported; I am aware that the Office of Fair Trading is already looking into revoking Roxburghe's consumer credit licence. I am also aware that you are just a call centre employee even when you pretend to be 'GW' (use the initials so they know they are sussed). 'So any contact at all, by letter or phone or text or email, from Roxburghe or any alter ego of Roxburghe, will be reported to the OfT from now on as you have been clearly told the debt is denied and I was not driving the vehicle.'

Any interruptions or comments from them - talk over them.

Get your words out, repeat if you like - make sure the word 'denied' is clearly heard - and then phone down.

They will not ring again.

typical scum bag company,,i have a draw full of loo paper from roxburghe and graham white(not) solicitors,,they are just the next desk along,,anyway me and 1000s of others actually wish they would take us to court,,they wont,,because they know they will lose 100%,,tell them if they phone again you are recording this call as they are harassing you.do not worry,,relax, these people rely on scare tactics to make you pay a meaningless invoice,,its not a fine,,they have just been tanned in court in stockport(where i live) and i loved it, and its not the first time either,,,they know people will pay if they get scared/frightened/bullied,,do not pay.they have zero legal status.
