HSBC Claim help required

Hoping someone can please help.

My wife and I had a series of PPI agreements with HSBC in the period 2002-2005. Unfortunately we ended up in an IVA in 2005 (this was fully paid off by June 2009).

We do not have copies of paperwork so following Martin's instructions on here I sent off a letter asking for copies of agreements under the Consumer Credit Act (1974). I can't remember what exact agreements and policies we had with them. I enclosed a cheque for £20 for me and my wife.

About a week later I got 3 letters in the post. One for a cardholder PPI, a Mortgage PPI and a loan PPI (In my wife's name) all came with a copy of the ombudsman questionnaire.

I subsequently have got 2 further letters from HSBC. One in relation to the loan stating that they were not obliged to provide me with details under the Act as the loan was closed, but gave me some detals of the loan and PPI policy (date taken out, amount etc). The second was in relation to the cardholder agreement and they said exactly the same thing but they were not going to give me any information. I await the mortgage letter with bated breath.

  1. Do they have to provide me with this information under this act? If not is there another route I can go?
  2. Is a separate questionnaire needed for each policy you claim for?
  3. Have HSBC been fined previously? Are they difficult to claim back from?
  4. Any advice on next steps would be really appreciated. I know for a fact that these policies were totally unaffordable and the extra cost really contributed to our 'bust' and subsequent IVA in 2005.

  • I have just rung one of those ppi companies for advice and someone has just told me that I cannot claim as I was in an IVA and the bank can take any money they owe to cover their shortfall in the IVA. Is this true? The IVA was fully paid off in June 2009.

    I'd be really grateful for some assistance.

    Hi there,i believe they can take redress to cover debts that were included in the IVA, having said that,i am not sure if they can do this with this being settled 2 years ago,post this question here

    If you have the account numbers and reasons for mis sell,then put claims in to each company.

    Look here for reasons for mis sell and all you need to know how to go about making a reclaim.

    They dont have to give you this info,but you have the info you need,the account number and ppi you paid to make a claim.

    1. Is a separate questionnaire needed for each policy you claim for?
    It is best to send each one seperately.
    Have HSBC been fined previously? Are they difficult to claim back from?
    Some have had wins with these,you just go with the flow.
  • If your policies were missold (which may or may not have been the case) then you can complain (not claim).

    However, if you were in an IVA then this suggests you paid less to HSBC than they were entitled to. They may take this into account in any redress calculation.

    Some ambulance chasers seem to have stopped taking on these cases because there may be no money in them to meet their fees even if they win.

    We were definitely miss-sold these policies using the criteria on here. I have had conflicting advice on the ramifications of a PPI complaint and a settled IVA. I have submitted two complaints. If they refuse, I'll go to the Ombudsman. My argument is that we may not have had to go into an IVA if hadn't been for all these additional PPI costs. I'll let you all know the outcome.
