    Hi Guys,

Thanks for all the advice, I replied to the seller earlier to say that I would wait until tommorow to see if arrives, and if not check with my local sorting office.

But assuming it does not turn up I'll go straight ahead with a paypal claim.

I feel a bit guilty (stupid I know) as I think he has posted the item, and he could potentially be out a lot of money, I wish I had opted for special delivery as it would have been trackable and not have been under insured.

But I suppose that is his problem not mine.

    Thanks again,

    Julie

It is the sellers problem, not yours because they're responsible for getting the item to you, the extra insurance and upgraded postage options are for the sellers benefit not yours.
The seller really needs to sort out his postage.

I have just received what seems to be a positive reponse from the seller.

They are now happy to send out a replacement via RMSD, they don't have any of the colour that I ordered in stock, so can only send out a different colour, I'd prefer the original colour I ordered but would happily settle for the alternate colour if it means getting my item.

Due my work schedule we've agreed to wait until Thursday to see if the original item arrives, if it has not arrived by then, they will send out the replacement on Friday via RMSD to be delivered on Monday (the only day suitable for me as I'm going away for 3 days after that)

If the original turns up I will send it back to him using RMSD, or return the replacement if the original turns up before it does.

I'm very happy with the solution.

Are there any pitfalls going through with this offer? I'm assuming I should keep the PayPal claim open until I actually receive the original or replacment?

Yes, don't close the dispute as you won't be able to re-open it.

    Hi,

Just thought I'd update this thread.

I received my replacement item on Monday, today I received the original item that was posted out on 18th October.

I have returned the original item to the seller using RMSD, so everything is sorted now.

    Thanks for all the advice.

Thanks for the update! Though I do have to wonder why you didn't send back the replacement if you preferred the colour of the original!
One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

Because I received the second item which was not my preferred colour on Monday, I had no idea if the original would ever arrive, so I opened and used the item. The original arrived 2 days later.

I did not think it was fair to return an item I had used back to the seller as then technically he could not sell it as new. I did not see why the seller should lose out due to RM taking 2 weeks to deliver an item.
