When to hand in notice?

  • If you want to start your new job on 28 November -

    if you have to give one month's notice you need to hand in your notice no later than 27 October so that it expires on 27 November (you don't count the day you hand in your notice as part of the notice period)

    handing in your notice on 28 October would be OK if you had to give just four weeks' notice

    Companies have various ways of working out part months and we don't know which yours uses. It is legitimate to divide a month's pay by the number of days in the month and pay for the number of days up to leaving. It is also possible to divide a month's pay by the number of working days and pay according to the number of days worked.

    Where I work we pro rate the month basd on the number of days worked / working days in the month. I think that's pretty usual. But your place may do it differently

    Im in sales and as soon as I hand it in I will be out the door on gardening leave so I would have thought they would count the day I hand it in?

    Well that is up to them but it would increase the number of days they have to pay you by one!

    If they force you on garden leave investigate a bit of overlap

    How much notice do they have to give you.

    What is in the contracts(Current and new) for not working for other companies.

    how much outstanding holiday(you get paid for that as well)


    You do have a unconditional offer of the new job, not dependant on references or anything?

    Im actually in recruitment myself and I dont think I have ever seen an unconditional offer - I dont mind it depending on refs as I have no problems there

    Seriously, read your contract of employment. How much notice do you have to give?
    If a month, put the notice in a month before hand. If you think they will put you on gardening leave, then they still have to pay you untill the notice pediod is out. Notice period works both ways.

    Also don't forget about any holidays. If you have any accrued and not taken holidays, they will pay you those (assuming you are really putting your notice in exactly on time for the notice period is out).

    Usually it is calculated:
    Annual wages / 52 weeks / 5 days in a week x working days in a month (supposing Mo-Fri job & equal hours each day)

    And yes it looks like you get paid on 26th for the month to the 30th/31st whichever applies (but check your contract if that really is the case).

    Also don't forget lower pay - less tax in that month (but then you will get higher pay in the next job, as in Dec you will get paid Dec and the 3 days in November or however many it is) and it will be higher tax amount in that month.

    So you tell them start date is "my notice" after the offer is unconditional
