Different councils have slightly different definitions.
I suspect that even though they appear to be self-contained flats they might not meet the building regulations to avoid HMO legislation.
Check that point.
Thanks POP - given that I doubt very much he has adhered to regulations or sought planning I imagine that is the part of the legislation that will play into our hands.
At the end of the day if he settles this amount (only 900 quid but my daughter doesnt have it) then happy days. I then just need to deal with my conscience about whether I report him in order to save other individuals from having probs with him.

Has the property been individually banded for Council Tax purposes by the Valuation Office ?.
Council Tax HMO regulations are set in legislation - does the property meet this -: http://www.legislation.gov.uk/uksi/1993/151/regulation/2/madeI no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0 -

Hi CIS.
Complicated stuff to read. Essentially this is a quite large house which has been split up into 7 bedsits - each with their own kitchenette and bathroom. Whether the correct planning permission to do this was sought and obtained I dont know. An initial look seems to indicate that it hasnt which I gather then would make it a HMO irrespective of individual bathroom and kitchen facilities.
The council appear to have been sniffing around the property for a while and have obviously contacted the landlord/owner who has provided information and tenancy contracts re the tenants living there. The council has responded to this by sending my daugher a council tax demand but she hasnt been able to find out if anyone else has received the same demand.
Landlord obviously a numpty but is providing DD with letter confirming that the rental being paid includes council tax. I know this doesnt mean the council will stop chasing her for the amount but at least means that we have something to go after with a small claim if she pays the bill.
Its driving her mad poor thing as she is one of natures worriers and I am having to keep her from constantly chasing the landlord as I want that letter from him at the very least and we need to keep him amicable if we can.
