Hi,
I'm a self employed driving instructor operating a franchise from the AA Driving School. Last week i was informed that funds were going to be withdrawn from my bank to pay for pupil introductory fees that which were undercharged over the past 12 to 24 months. This was a as a result of a clerical error on there part and I received no notice prior to them making a request from my bank.
Could anyone please advise on the legality??

Do you agree you were undercharged or not?
If you do agree you were undercharged then the fact part payment has been made makes little difference.
If you disagree you were undercharged then you need to refer to your contract or an attached schedule which should at a minimum state the way it is calculated.
The payment should follow normal terms of X days notice if you have a DD set up or X days to settle if its normal invoicing.0 -
I presume you have a franchise agreement in place? Does it lay out the fees involved and are the fees they are now claiming correct? Franchise agreements are usually very comprehensive so this would be the best place to start.0
