Hi, i need to know whether or not an 84 year old british overseas citizen with indefinite leave to stay in the UK, returning to the UK after 15 years or so to live here permenantly will be eligibile for pension credits or any other benefits whilst staying here.

If you look up 'habitual residency test' that will give you some info. I'm not sure what it is in full, but they will need to be able to show that they haven't returned merely to obtain benefits, or else there will be some time specified before they can claim anything.0

Are you saying they have an ILR (Indefinate Leave to Remain) visa, or that they have a British passport?RENTING? Have you checked to see that your landlord has permission from their mortgage lender to rent the property? If not, you could be thrown out with very little notice.

My mother left UK to live in India because of the difference in lifestyle. She used to live there with my elder brother. Is she not eligible for pension from wherever she has spent all but four of her years of life? I know that when I retire, I'll be collecting pension from Australia, Canada and UK, as I have contributed to pensions in all of these places in my working life, so they are each liable to pay me.0

Are you sure her ILR is still valid?
Normally it ceases to be valid after a 2 year absence....much enquiry having been made concerning a gentleman, who had quitted a company where Johnson was, and no information being obtained; at last Johnson observed, that 'he did not care to speak ill of any man behind his back, but he believed the gentleman was an attorney'.0 -

I thought that a holder of a British Overseas passport was a British National, but not a British Citizen?
From what you have said, it seems that she is a British national who had an ILR visa.

Under the last government, some foreign nationals could claim as soon as they enter the UK, even those that had never been to the UK before.
