Unfair redundancy?

Just to quickly add that the purpose of the appeal has to be to try and get your job back though this rarely happens in practice (because making a u-turn on even a poor selection choice may have consequences). You need to be discreet. A tribunal will only compensate you for your loss from being out of work qand would expect you to take your job back if offered. I assume you don't want to go back because of the way you feel you have been earmarked. However at this stage you must not think about possible money but instead following the process.
I was involved in a redundancy project last year and we selected someone to go partly based on bradford score, she appealed saying it was discriminatory and the result was that she stayed and her colleague, the next poorest scorer, was made redundant instead. So it can happen.0 -
Just an update in regards to redundancy situation.
I have now had two appeal meetings in which I think that I presented myself well. I pointed out that I was working to a team size far larger than my full time co-workers and thus the work balance was not fair.
I also pointed out that one incident of sickness was due to my diabetes and should not included. They advised me that they cannot find any paperwork to support this but I have advised them that a return to work interview was carried out and then an error was made in regards to my pay. I did not have the return to work but I did have the payroll note to pay me.
I was gutted at the scores that they had given me for skills and experience and as I had not had a formal review for over 2 years how could they judge me like this?
Well last Wednesday I found in a drawer my "Management Development" results in a test that I sat in late July/early August. These showed a completely different set of results for me. I scored top marks in each catagory - over my collegues that scored higher than me on the redundancy matrix. On top of this was a score and remark by my manager stating that I was a highly experienced team leader who excelled at communicating and developing her staff!!!
I am awaiting my outcome next week and have decided that if they are still going to make me redundant that I will be going to an employment tribunal.
I have found it really hard going to work when all this is going on and cannot believe that a company can treat its staff like this. I want to keep my job due to the current job market but if any other jobs come up that fit with my family then I am OFF!!!!0 -

Hi there
Do you not fill in a sick form when you go back to work after being off? If you do surely on that will be the reason you were away.
These are normally filled in so the company can't make up false attendance records.0 -
In reply to the last question. Yes my company fill in Return To Work forms on return from sick leave. I did have a meeting and said form filled out but they it would seem have lost it!0

Just an update to advise that I was sucessful in my appeal!
I was advised on Wednesday that it was being upheld and that was on 3 grounds.
I am keeping my job - which is a relief as there was not a lot out there that I could do with having three children as well.
A little upset that it had come to this and very frustrated with the system but at the end of the day I STILL HAVE A JOB!!!
I would encourage anyone else who thinks that their redundancy is not quite right to appeal as it can work.

Congrats. I've followed this (albeit quietly, no advice to offer, sorry), and I can feel your frustration. Well done on finding the Management Development paperwork too. It is tough out there right now.0
