Section 75

Hi, I'm not too sure how section 75 works in action and just wanted to get my facts straight before writing to my credit card company. I made a purchase for a trial of a product from the internet, with a 14 day cancellation period. I cancelled after 8 days by phone (which was very hard as the company were really difficult to get hold of). When I received my credit card statement they had taken two payments one of £75 and one of £79 in the same month. I have not received any further product or correspondence from the company. As they total over £100 and relate to the same thing can I claim from my credit card company as no goods have been received? As I don't have written evidence of the cancellation I am not sure I can rely on this- I have now put everything in writing to the e-mail address they provided so I'll have evidence ongoing. I have searched for the company on line and many people have posted about similar problems with hundreds being taken from their accounts - I warned my credit card company but they said as they have my card details they can't prevent payments I'll just have to keep disputing them. I'de really appreciate some advice. Thank you K.

    If individual purchases are less then £100 you'll struggle with a Section 75 claim, you can't add them together. If this relates to weight loss "tea" or slimming supplements, there are loads of threads on the forum, just search for the company name, you'll find them. Cho Yung Tea, Acai Berry, Britewhite Teeth Whitening, and loads more ! Ask your CC issuer to dispute the payments, either for non receipt of goods or cancelled continuous authority, doesn't matter you don't have proof of cancellation, they can still action a a chargeback for you. You should exhaust this option before asking about Section 75.
  • Thank you - I'll do both those things - I have disputed it with the credit card company but like to be prepared and hadn't heard about section 75 before.

    Note you can't get a refund purely under Section 75, rather you use Section 75 to apply any contractual liabilities on the seller to hold the credit card company jointly liable.

    Assuming Section 75 applies, then presuming this wasn't a 'customisable product' in any way easiest thing would be to use Section 75 to apply your rights to cancel under the Distance Selling Regulations.
