Can anyone tell me if this sounds right?!

About to start IVA as awaiting final figures (while the kind solicitor chases companies who have not responded - thankyou!!)

Anyway have already paid £3000 up front - Is this usual?

She has not informed me about monthly payment and was quite rude to me the other day by telling me my house should have been up for sale to prove to the debtors that i am serious about repaying the debt, do I really need to put my house on the market?

I'm so confused and very worried that I am about to loose everything.

    Sweetie - sorry, but no. You oughtn't to have to sell your house under an IVA, or pay anything upfront! What is the name of the company you are in touch with?

    I got my IVA a few years ago, and didn't have to face either of these situations.

    I, too, would be interested to hear who this comapny is. You don't need to pay upfront fees if you use a reputable company. Contrary to popular opinion, there ARE reputable companies other than Payplan and CCCS. Have a look on https://www.iva.com and have a free word with a couple of com0panies there too.

    Incidentally, you refer to the "kind solicitor" .... the person who runs your IVA is an Insolvency Practitioner, not a solicitor, and should, hopefully, be licensed as such.
  • Thankyou, do you know if we are in a position to go with someone else? or is it too late as we have not yet received the final figure.
    We have a meeting with CAB in a few weeks.

    Hi again. I am loathe to give specific advice as I am not entirely sure of where you are in your current process. I am, however concerned that it appears that you have paid this, not insignificant, sum of money up front, before, it seems, your proposal has even been drafted.

    Assuming you have not signed any agreements you are able to withdraw before the IVA is up and running, however, it is likley you will lose the monies already paid. It would not surprise me if you might lose any more paid to this company, as they don't sound "right", I am afraid,

    Hi, I am just visiting my mum and told her I had been on here asking advise.
    She said they are 12 months into the IVA, looking through her paper work it states that house will have to sold asap and it basically does not matter if they have anywhere else to live and have 3 years to do this in.
    She also received a very horrible letter this morning from the company saying that she was now in breach of the contract and to remedy this as they were not very happy!
    As the CAB meeting is too long to wait she has cancelled and trying to see if she can get someone to look over the paper work for her.
    When she was starting this apart from having to close the family business her brother had terminal cancer so was not really taking much info in at the time and thought the company was working to help her.
    I still can't understand why this situation seems so different to the usual way of IVA which is paying monthly over a 5 year period and then in the 4th year you get your house valued
    The company is Parkin S Booth.
