returns item lost in post- can i get my refund?

Hi,
i hav ebene having some problems with an online order.
I placed an order on a website, but received no confirmation email etc and then saw that the money had been charged to my account.
the Goods then turned up, but didn't fit so i planned to return them but couldn't access the website "my account" feature
i rang the company up and obtained a returns number and also corrected the account issues.
this was over 2 weeks ago, i still cannot access my account and now my returns parcel has been lost in the post.
The response to my emails have been ridiculously slow compared to other online site i have used in the past.
i wanted to know what i can do about this, and how i can get my money back?

What was the value of the item you returned and exactly by what method did you return it ie Royal Mail...Royal Mail recorded delivery/special delivery etc?

You'll need to be able to prove that you returned the item, so unless you sent it tracked, then your only chance of a refund is to claim via the people you sent it with (i.e. courier or royal mail)Should've = Should HAVE (not 'of')

Under DSR you should get a refund whether they have the goods or not, it should be refunded within 30 days. You would have to inform them by durable means for this, an email would do.
On the flip side there are not many who will refund without first getting the item back, I wouldn't and not many will. You can complain to trading standards about this, unless they have had a lot of complaints about the company they will tell you to start a small claims action against them to protect your statutory rights. On the other side they can then counter sue you because you failed to get the item back to them, this is a statutory right they have.
If you have proof of postage of some sort you could claim from the Royal Mail, this will get you your money back.0
