Item not as described...

So I bought an item on eBay. Listed as brand new unused and complete with all the bits.

Received the item and it's been used although in very good condition and some bits are missing from the box.:(

Messaged the seller and told them these issues and they said sorry they thought it was new and that they were selling on behalf of their mum. I messaged back asking them to ask their mum to try and find the bits for me. They then said they'd seen their mum that day but only shortly and hadn't had time to ask her and that as they're busy this week they'll ask her when they "see her longer".

What would everybody else do? I've never had a problem before on eBay even though I've bought and sold on there for years. I'd rather keep the item but I bidded under the assumption that is was brand new with all the bits and feel I've paid over the odds for something used.

Should I wait and see if they can find the missing bits? Or just raise a PayPal/eBay claim? Ideally I'd like to keep the item and either receive the missing bits or a partial refund to cover the missing bits and the fact it's used. Is that possible?

    I'd bung in a claim for SNAD but be prepared to send it back fully tracked at your own expense.

    I'd give the seller a couple of days to find the bits. If they do find them, then perhaps request a partial refund.

    If they can't find the bits, ask to return it, and send it back tracked.

    Don't open a dispute unless the seller is being difficult! Give them chance to resolve it first.

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    It sounds to me as though the seller is being difficult, they'll ask their Mum some time?
    Most decent sellers would try & resolve this straight away, after all most people have phones so they could phone their Mum.
    I'd open a SNAD, unless you're happy to keep it for the proce you paid.
