We've found a new place so I will give my notice on Monday 24th which is when it ran out 2 months ago then move out on 24th November.

Rental periods don't run from the 24th of one month to the 24th of the next. Please ensure that you give the correct notice timed properly and do not stay one day over into the next rental-period or you will be liable for another month's rent.0

Why doesn't it - I moved in on the 25th Jan signed for 6 months - it said on contract end of AST was 24.7.2011

Is this always the case? My tenancy has a clause whereby we have to renew every six months if we want to stay in the property, and they will make us pay each time for the privilege!
Because it was in the agreement I guess we do have to go by this then, and we can't argue otherwise?0 -

My first question would be why did you even sign a contract that had that in it!!? So, if you want to move you have to time it just right to get out of your contract!!?
Also, how much do you pay for each new contract? x2/12 and that's how much the place is "really" costing you a month!0 -
Regarding when to give notice.
I am too am going to be hopefully leaving my flat when my house purchase goes through. I am on a rolling contract and have to give 1 months notice. Now I emailed the company I rent from and they said that the 1 months notice will be from when they receive the email/letter (was a bit worried when they said they would accept an email as notice!! I will be sending a letter and an email anyway).
So is this ok or should I look on my contract and see when my contract started and it will be 1 month from that date? Just a bit confused is all.0 -

You must get the date right. If your tenancy 'ran out' (you mean the fixed term ended?) on 24th then your periodic tenancies run from 25th to 24th of each month. Give notice to arrive by 24th Oct and your tenancy will end on 24th Nov.Thanks for all the info guys, much appreciated

Dodgy clauses in your tenancy agreement cannot over-rule the law. You do not need to sign or pay for a new fixed term eachtime it runs out - you can move automatically to a periodic tenancy without doing/signing anythng.Is this always the case? Yes and no. The date the notice is received is the critical date, not the date you send it. Yes, use the post - not email.
They are wrong about the 1 month. It is not one month from the date received, it is one full rental period from the dtae received.
If your rental periods (like the OP here) run from 25th to 24th of each month, you can give notice at any time up to the 24th (eg notice received 0n 20th), but the month will run from the 24th.
So yes - check your original tenancy agreement to see hwat date the fixed term ended and the periodic tenancy began.0
