Asda Barnsley Car Park - Parking Charge Notice

Hi, I have a company car leased by Honda - I was informed today that they have received a parking fine for my car in Asda Barnsley Car Park on a Saturday. They claim I arrived at 08:49 and departed at 12:32 and that they have photographic evidence of this.

Now I did arrive at 08:49, but I departed at approx 10:00am and returned to the car park at approx 12:15 on the same day, leaving at 12:32.

Unfortunately, because the notice has been issued to Honda Leasing (who own the car), they paid it and forwarded it on to my company's accounts, with a £10 admin charge. My company's accounts department (god love em!) have paid the £40.00 to Honda and now want the same amount from me.

How can I dispute this and can I get them to go through thier photographic evidence for that day (24th September) to find my car leaving and returning again?

Thanks for any assistance anyone can give.

  • Get the terms and conditions of the lease (if you can) to see what the wording is regarding fines (real ones that is) these are not fines but just invoices which should not have been paid by Honda in the first place. Someone on here will have the link to a piece by a transport manager, hopefully they will post it.
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.
  • Issuing PCNs for double-entry (oo-er :-) seems to be a rather common occurrence for the PPCs, and indicative of the shabby way they operate.

Both Honda Leasing and your company have been fools to blindly accept the scam. Make sure you don't get sucked into the same thing. There are a number of similar threads on this forum. Bottom line is that it's not your problem, it wasn't a fine/toll/other statutory charge, and the PPC is not an "authority" to whom your details need to be disclosed. As stated, check carefully the terms of your company car policy (reproduce here if possible, so they can be commented on). You need to be firm, but polite, with accounts and, if necessary, HR.

Don't bother about photographic evidence and so on, to try to dispute with the PPC. It'll be a frustrating experience and a waste of time. If Honda or your company want to pursue that approach, let them.

They do not have photographic evidence in this case as it is quite meaningless in the context of private parking. So don't waste your time.

Even in legit enforcement, PE is the bottom of the evidential food chain and would only be considered after everything else had been submitted and most often only to clarify a minor technical point.

I did have a very good tip off that PPC have managed to work out which registration offices lease cars use and if they pick up a said registration in that a outside area they know they have a 100% hit.
They know the money will be paid straight to them.
I would ask for a meeting at the firm and point out that you will not be paying a speculative invoice and if it is taken from your wages you will sue for the money back.
that waht they have in fact paid is a scam and if they want to pay scams, more fool them.

  • My thanks to everyone who have replied, unfortunately my company is quite small so telling them I'll sue them for the money is not an option.
I will be telling them not to pay any more "fines" on my behalf until they have checked with me first.

I think Honda leasing are also very cheeky, charging the company £10 because one of their lease cars appears to have a fine.

I will take the advice and follow up on the terms of the lease etc., and, if I can post the details here.

Would Honda just pay a speeding ticket ?

Read this thread very carefully and follow the emails the poster used:

Honda Leasing have made a huge mistake but that's not a reason for you to have to pay them for that mistake. This was never a parking fine and was not actually any of their business - they should have binned the speculative letters from any private company - they are not liable and were in no danger of Court or anything. They had NO reason to act on this at all, any more than if any random company happened to write quoting one of their car reg numbers...think about it - anyone could scam a hire company if their systems are not robust enough to spot the (easy) difference between a real Penalty Charge Notice from a Council and a fake version (parking charge notice' from a PPC).

Show them this link as well as using the wording in that thread I linked:

TBH I would be very very polite but carefully word your emails to them so they realise they have in fact been scammed. They fell for it; you didn't, they should swallow the cost.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
