2mph accident - insurance have paid out £5K to other party!!!

    No that's not right. If you had a bruise and wanted £20K then I can assure you that you wouldn't get it.
    When my MIL had a claim she had to see a medical examiner chosen by the 3rd parties side, so no, they are not just paid out.
    The medical evidence is checked and in some cases you have to go for more tests/examinations.



    Because solicitors are a highly trained profession and therefore expensive.
    Also medical fees need to be paid and also expenses (taxis?).



    You still need a solicitor to advise you whether the amount you are being offered is reasonable and to give you legal advice whether to accept/reject/go to court.
    The average person has no idea what compensation is reasonable for suffering.
    How on earth would an ordinary person know whether they are being ripped off with a low offer or whether it's reasonable and they should accept.
    Frankly most people would have no idea whatsoever.
    Also some people need negotiating through the legal process. My MIL is 84, doesn't hear or read well, there is NO WAY she could take anyone to court without assistance.

    The issue is with the whiplash claims, not someone who clearly has an injury, e.g cuts, bruising, broken bones.

    The insurance companies know how much a whiplash claim is worth.
    Agreement is reached swiftly and it doesn't need much legal expertise to submit the claim and agree the lower offer when it comes in. A couple of template letters and a report from the Claims Management companies resident medic. These rarely end up in court and need a legal argument to support the claim.

    It's easy enough to find out what the going rate is for a whiplash claim.
    Mr Straw described whiplash as "not so much an injury, more a profitable invention of the human imagination—undiagnosable except by third-rate doctors in the pay of the claims management companies or personal injury lawyers"

    How do you find out the costs of claims ? is it a case of calling your insurer to ask what they paid out relating to an accident ? I noticed on the car insurance websites, it always asks for the amount 'claimed'.....
    My partner has 3 accidents this year, 2 of them not her fault (other side admits liable, all sorted), and she hit the rear of someone.....
    The 2 where someone hit her, i told our insurer i would deal with the othersides insurer directly..... but in terms of the cost to put things right with regards to the questions asked when getting insurance quotes, what would i put down ?

    As for when she hit someone, should she just call her insurer and ask what they payout was ?

    Not for an 84 year old person with alzheimers ready to go into a nursing home it's not.
    Just because YOU can do it, don't assume that every other person can (it's called empathy).
    Children for example should be entitled to be adequately represented even if their parents were deceased.

    If people want claims cost to go down, then they should be more careful about having shunts however minor.

    No - there'll always be accidents. You've got two metal boxes moving at speed - its gonna happen.

    What needs to be done is something to ensure only GENUINE claims are paid out not just ones where everyone claims because they know they can get away with it!

    This post makes me angry, it puts my already extortionate insurance up being a young driver!

    I would have a right mind to phone this person up and ask what they are playing at if you still have their details!

    Yeh I did that at the time. Probably not too clever thing to do but like you I was annoyed that someone was so blatantly taking the p**s.

    I spoke to the ladies partner and told him that they were having a laugh. He just got arsey on the phone and said it was tough luck because it was my fault I'd hit her. Not exactly the point....

    I told him my insurance company were investigating it (they were initially but then dropped it) which I thought might put him off. but he could smell an easy pay day I guess.

    If your attitude is that 2mph crashes are inevitable and there is nothing at all you can do to improve your lot, then I'm afraid that yes, it is gonna happen again.
    I really hope you do get someone in a metal box next time as well and not a pedestrian, cyclist or motorcyclist.

    I don't consider myself an expert, that why I try improve.
    It appears that you think you don't need to.
    Perhaps if everyone was as good as you then there'd be no need to even have insurance
    It's a legal requirement.
    But certainly if you had my qualifications you'd get a discount in recognition for making yourself 70% less risky.
