Talk Talk Problems

I have been having an ongoing problem with Talk Talk regarding an account that has been set up without my authorisation.
I originally had a talk talk account which i was fairly happy with. However, there was a problem with the Direct Debit (which a customer service monkey told me was because Talk Talk had put an end date onit when it was set up) which meant that the bill didn't get paid for a few months. I was not informed of this and didn't pick it up myself, and the first i knew was when i received a letter from a debt collection agency. I paid the outstanding amount and told them i wished to close the account and would revert back to BT. It has appeared that they then set up another account (with a different account number) and took the call charges back from BT without my knowledge. I did not receive any details that this would be happening or any bills from them and no D/D was set up for this account. Quite obviously it went into default and again they passed it to a debt collection agency. I contacted Talk Talk and refused to pay the charges and asked for it to be passed to their complaints department. I have never received any communication from this department and have been variously been chased by several different debt agencies for the money (all of whom have backed off when i have explained the situation to them). I have now reached the point where i need to resolve this issue ( it has been ongoing for just over a year now and i know i have been slack in getting it sorted out) and i was wondering what my legal rights would be in this situation. My ideal resolution is to have the charges on the account wiped clean and any adverse information on my credit file erased.
Also, how do i go about complaining about the way Talk Talk have acted in this issue and the fact that they have set up an unauthorised account in my name and have harrased me ever since to pay monies which i do not belive i am liable for (I understand that i did receive a service from them but i don't see how i can be liable when i have not agreed to it or signed anything giving my consent).

You may be (un)lucky and get your complaint passed to the Investigations Team.
Cut and run if you can and thank you're lucky starts if you succeed.Time has moved on (much quicker than it used to - or so it seems at my age) and my previous advice on residential telephony has been or is now gradually being overtaken by changes in the retail market. Hence, I have now deleted links to my previous 'pearls of wisdom'. I sincerely hope they helped save some of you money.0 -
You could try calling their High Level Complaints Team.

Thanks for the help guys. I was starting to think that the Investigations team didn't exist as they have never got in contact with me and you can't be put through to them from the call centre nor be given a number for them. Very suspicious, so it's nice to have it confirmed. I will get onto the Hi level complaints department first thing tomorrow.
Just a quick question, can i take it as fairly sure that seeing as this issue has been ongoing for a year and they haven't threatened me with any kind of court action that i am on reasonable ground in my defence? I would have thought that if they were certain that I owed the money and had defaulted then i would have been sued for it by now? (it is only for about £40, but these companies don't usually worry about that sort of thing).0
