Amazon - wrong item, right one now not in stock

I'm looking for some advice regarding a computer component (graphics card) I ordered from Amazon. The graphics card comes in two different model numbers and the different model number denotes whether you get a 10 year manufacturers warranty or only a 3 year one. The 10 year one is understandably more expensive (it's probably made with higher quality parts). They are identical in every other way so people who don't understand the difference are often caught out.

About a week ago I ordered a 10 year model direct from Amazon. It seemed like a bargain because the price it was going for was much more like the prices I had seen for the 3 year model previously. It finally arrived today and surprise surprise, it's a 3 year one. I have gone back to the website to check my order and I definitely ordered a 10 year one, I also notice that Amazon no longer have it in stock, it's only available from 3rd party sellers for a much higher price.

The 3 year model is now advertised as available from Amazon, and guess what, it's going for exactly the price I originally paid. I spoke to the Amazon call centre and they acknowledge that they've sent me the wrong item. They said I can return it for a refund, and then reorder the right one when they have it in stock. The problem is I just know now that if they ever have the 10 year back in stock they will be charging a much higher price for it.

Basically I don't want a refund, I want the right item, at the price I was sold it at originally. What are my "rights" here?

    A refund fulfills Amazon's duty.

  • Amazon cannot sell you something they do not have.

    You need to read the T&Cs of their site, in theory if they are unable to fulfil their contract they would be required to cover the additional cost of having someone else to fulfil it (ie the difference in price of you having to go and buy it elsewhere) but I'd be highly surprised if this liability isn't mitigated in the wording of the terms you agree to by buying from them.

    This is the kind of thing I was hoping for, but yes it seems that's just not how they do things.
