    Why would you be asking?

    They're not going back to 03-04 with underpayments - generally. And you're out of time to claim an overpayment.
    If you want to test the depth of the water .........don't use both feet !

    It's wrong. In essence HMRC are primarily d/w 10/11 in this round.

    But post #7 on this thread clarifies it a little more.

  • Rec'd notification from HMRC owed £362.20 from Jan - April 2009 as underpaid. I retired on 29 Dec 2008 (60th) and moved to state + private pension incomes from 30 December 2008. On 8 January 2009 HMRC notified my employer of tax code change from 603L to 45L. Obviously my employer had not forwarded to pension company and this has now resulted in this underpayment. Should I be liable for this error by HMRC and does the 12 month rule apply ?

    I may be missing something here but I fail to see how this is HMRC's error.

    They issued a tax code to the employer they had on file at the time.

    It is unlikely they had received the notification that you had left your employment before 8th January. It is also unlikely they had received the notification that your pension had started by 8th January as the notification is not sent until AFTER the first payment is made.

    Can you explain 'after the first payment' ?
    Also would the 12 month rule for ESC A19 ?

    Did you provide a P45 to your pension provider when you ceased working? As that appears to be the bit missing.

    ESCA19 can't apply in this case as a revised Code was issued by HMRC. But it would appear that was triggered by DWP advice that a State Pension was about to be paid - although the sum looks rather excessive for Jan - Apr. Did you complete a P161 (Pension Coding) form in late 2008?

    Additionally - you would have had a copy of the revised coding. Did you not check your pension provider was operating it? As a fundamental of ESCA19 is to the effect you believed your tax affairs were in order.

  • Morning all and sorry for the quick, possibly incoherent post. I have.just opened a letter that seems to say i.owe £2200 in tax from 2004 - 2007. Obviously i am annoyed and hope to refute payment, i wonder if anbody could advise me on the reliability of the prefers, given its date. I saw a discussion that suggested a time limit on such payments and wondered whether this would apply to me. I dont know if its worth mentioning that the work for this period was agency, therefore adhoc work?. I would greatfully appreciate any advise or suggestion before i make the dreaded phonecall to them to check. Big thanks.
