    That's a lovely attitude to have I must say.

    ESA is a benefit administered by the Jobcentre. We receive downloads from the Jobcentre which tells us about when changes are made to other benefits and they know that HB/CTB are interested. In my LA, we take action on these daily.

    This would suggest to me that ESA have only just told them that ESA was not paid for a period but they should not suspend a claim unless there is a query over ongoing entitlement.

    If the work was through the Shaw Trust, it is likely to be permitted work and there are disregards which can be applied but they will need something to show the income. Perhaps a letter from the person who employed your relative would be sufficient for them. It would for us I reckon.

    We aren't idiots, but people do make mistakes. In my view and at my LA, we would use what we call a £999 income to remove entitlement for a past period (called a closed period supercession) and then re-assess when we had the information we needed. I don't think the ongoing claim should be suspended.
    I currently manage a Housing Benefit service and have been working in Housing / council tax benefit (as was) since 2001.

    Spoke to the jobcentre and they have stopped ESA now too, my mums partner has started refereeing football at weekends it works out at £40 a week which he did on Incap but they said it wasn't an income as it is classed as a hobby/sport?

    I know ESA rules are the same, he only does the season Aug to May so I know it is under 52 weeks, apparently they sent a letter asking for details of how much he is earning from football, hasn't arrived yet though.

    So it has gone way above my head.

    Council are saying it for a period back in March and JCP are questioning the stuff he is doing now so now sure what the council are really after?

    The football started again in Sept, so I can understand the jcp suspending claim until they have info.

    Perhaps they're wondering how he's well enough to work and referee football matches but is still claiming ESA?

    Nope they want to know his earnings, been for a medical etc.

    Income based I believe, not 100% sure.

    I have read permitted work rules and it should fall into the permitted work rules.
