i got my p45 through a couple of weeks ago and as it's unlikely i'll be working again the rest of this financial year (full time student doing a masters), i want to claim the tax i have paid back.
can i apply for a new p45 to be sent out or am i up slack alley?

If it was one of my clients' payrolls you'd have a copy P45 by e-mail within 24 hours if you were OK with e-mail format. No reason why getting a copy should take more than a week.Hideous Muddles from Right Charlies0

An employer is not allowed to issue a second P45 so you will need to contact HMRC to see if they can assist. They should have the details as your last employer will have advised them of the P45 details.0 -
Contact the employer and ask them for a DUPLICATE P45.
If they refuse to issue a duplicate, which many employers do as they believe that it is not possible to do so, then ask them for a statement of earnings for the period 5 April 2011 until the date you left. Ask them to ensure they show your date of leaving and the final tax code on the statement.
Download a P50 form from the HMRC website, complete and submit with the P45/Statement of Earnings.[SIZE=-1]To equate judgement and wisdom with occupation is at best . . . insulting.

It is no good asking your employer for as duplicate P45 they are not allowed to issue one, you need to contact hmrc for advice. The following is from the employers guide to PAYE"Form P45 lost or incorrectYou must never complete a further form P45 or amend a P45."
If a former employee loses their P45 tell them to contact their
HMRC office immediately.
If you realise you have issued an incorrect P45, write to your
HMRC office with an explanation.
They may well accept a statement of earnings, I don't know, they will advise you.0 -
If that is the rule it is about as stupid as its possible to be. I've had clients who've had duplicate P45s from very large companies, so clearly I am not alone in either not knowing about this rule or not caring about it. It's silly rules like this that leads to millions of tax codes being wrong.Hideous Muddles from Right Charlies0

Just to emphasise how daft that rule is, I offer clients 3 options for payslips, P45s and so on:
1. In the post on paper. (5% do this).
2. E-mail on PDF format. (93%).
3. Client can log in and run off files directly, employees can have e-mail access via separate passwords to their own payslips and other forms. (2%)
Under option 2 the P45 is very often completed after the staff person has moved on - note many of my clients are hotels and pubs in the Lake District. So in these cases clients are often forwarding on the P45s by e-mail anyway. So this is a rule designed for the 19th century partly responsible for a mucked-up national PAYE fiasco in the 21st!Hideous Muddles from Right Charlies0 -
Unfortuneately there are many payroll departments in which there is no-one who has read any of the instruction books issued by the tax office. This is one of the reasons that many people have problems with their tax, the tax office are not reponsible for all the mistakes.0

how will they do that without knowing how much tax he has paid?
Because they will know how much tax he has paid - d'oh! He has lost his P45,but the P11figures will still have been submitted to HMRC (over 85%) of employers now must file on-line....
If they do not yet know how much tax he has paid/was dueto have paid they will instruct him as to waht to do next.... a lot better than asking on here when some people clearly have no idea what they are talking about no??!:beer:0
