Selling house noisy neighbours

Hi all we got our house valued this week as we thought and think of selling we are in a terraced house been here 10 years now but both neighbours are rented houses so we have had allsorts over the years even good neighbours ,both neighbours like to play their music not everynight and not for long but it irritates me now im getting older and think of both my dd education as i dont want them woken in the night .
I have asked the neighbours if they mind keeping it down which works then doesnt but have never complained to council or whoever
Will it be impossible to sell do i have to tell the viewers of sometimes loud music at midnight as i dont want to sell and end up getting sued

  • Absolutely, say nothing! Noise is one of the biggest reasons to move, but one man's noise is of no bother to another person. I moved because of noisy neighbours, but the people who bought my house have never had a problem with noise and get on really well with the (ex) noisy neighbours. And they are still happy after six years.

  • If you haven't made any official complaints, legally there is nothing to disclose. The burden would be on the new owners to prove that you knew about the excessive noise when selling, if they were ever to try to sue. Without any official complaint or any complaint made in writing, they won't be able to do this.

    Ethically, it's a different matter. But if you do disclose noisy neighbours, realistically, are you ever going to sell your home? I have recently bought, and wouldn't have expected a vendor to disclose this. A savvy buyer would come around at different times of the day to check what the noise levels are like. It's part of the due diligence of buying a house.

    Personally, if asked directly, I would say that you have never made a formal complaint against a neighbour for any reason, and leave it at that. Chances are if the neighbours are tenants, they will move on, perhaps even before the new owner moves in.

    I don't believe you are legally obliged to tell any one about noise from the neighbours that has never been the subject of a formal complaint, other disputes are different (like if you have been fighting for 10 years over a fence in the wrong place) but noise is subjective and what my husband finds unacceptable, I often don't notice.

    I can hear the baby next door crying and for some reason every time we go in the garden out she comes with her kids, it's annoying but we're not very friendly like that, another person might think it's great to be so involved with your neighbourhood and may not notice the kid at night, if they go to bed at a different time to me, I doubt he cries ALL night.

  • Thanks all put my mind at ease can i ask if the neighbour 2 doors down put a complain into the council regards the neighbours in the middle of us ;will that come up on the search or just if we complained

  • You wouldn't have raised the complaint therefore you have nothing to disclose. If any potential buyers are sensible they will knock on neighbours' doors and talk to them which may bring to light potential noise problems, but you can't do anything about that so it isn't worth worrying about.
