Am Scared To Try For More

Hi Guys

I sent away for my credit card charges from Halifax and i asked for £380 charges and £75 intrest. They wrote back to me offering half the amount minus the intrest and it was £202.50 as i forgot to put 1 of my chrgaes on my first letter, so it was really £405 i had been charged.

However am considering takeing the £202.50 as am worried that if i go to court i might not win. If i go to court is there a chance i might lose and also if i win do i get the full 100% and also the intrest ?

Plus 1 last thing, do i have to change it to £405 charges as i orignaly put £380 becuase of the last charge i forgot to mention. Thanks

    When people are pursuing their claims for the full amount. The banks are paying out at least 99.9% of the time. If you carry on for the full amount, you will very likely get it.

    If you go as far as a court claim. You can claim interest on the amount (at 8%), and the court fee.

    Send your next letter to the bank including the charge you missed off. I would say........go for the full amount, why settle for only half your own money back?

    Conduct all your dealings in writing. If you do end up issuing a court claim, it's better to have proof of all your dealings with the bank. You wont have this if you speak on the phone.

    Follow the steps set out in Martins article.

    when i write the new letter and include the other charge on it, do i stick the intrest for that 1 also in the letter? And also since ive been writieng to them for over a month now, do i stick another months intrest on all the charges or just leave them? Thanks very much

    You are only entitled to claim for interest once you've issued a court claim. At this stage of writing to the bank, you should only be asking for the charges themselves. Claims in a county court allow for interest to be added to a claim (s69 County Courts Act).

  • Must say this was very quick and easy. Told the bank i was not happy with half and told them that I will take it further and they could be looking at court fees and intrest charges on top of the £405 and I got a letter today saying they will give me the full £405 :)

    Is it possible to claim from sky digital? I think ive had 2 or 3 charges for not having enough in to cover it.

    My dad passed away last year and think he might have had a few charges over the last 5 years, would we be able to get this back? He had a single account and not a joined 1 with my mum.
