A non dep is someone who lives there on a non commercial basis which isn't the case here.I currently manage a Housing Benefit service and have been working in Housing / council tax benefit (as was) since 2001.

Ok, here's my knowledge on this issue.
1. Marc is just renting a room from the OPs pal (who I will refer to as OP 'cos I'm lazy). It's not commercial, so he is a non-dependant.
2. The OP "should" be assessed on the LHA for the area based on 1 bedroom, but as Marc is in the house too, it increases to 2 bedrooms.
3. As Marc is a non-dependant, the HB payable based on the 2-bed LHA is then reduced based on his income. If no income details are provided / available, the highest rate will be used.
If the OP can give details of where the property is or what the 1 bed and 2 bed LHA rates are, someone can probably give an accurate assesment. :cool:0 -

Well, having re-read what the OP put and what you've put, it sounds like you want the system to run in an individual way for you, rather than according to the law, which is the way it will be run.
1. Marc's money is not income for JSA purposes, it's a non-dependants payment towards household expenses which only affects the HB payment. JSA shouldn't be affected.
2. OP (or D-A-F) should get the 2 bed LHA rate, less a deduction for marc's income. If DAF doesn't / can't tell the council what the income is, they should use the maximum figure (about £60 a week).
If the LHA rate is £150, OP/DAF should be getting this reduced by £60 a week to £90 per week.
So:
JSA in full - marc's dosh is not a concern for them.
HB - £150 per week - £60 per week leaving £90 per week after deducting for marc's dosh.
All based on the info provided and limited to my knowledge / understanding of the regs.
Happy to be contradicted by those that might have better / more up to date knowledge, but for god's sake don't drag any deary65 threads up. :cool:0
