Motability - DLA Appeal - Heads Up Folks !

Ordinarily Motability allow you to keep your vehicle for your appeal period.

Because the appeals delays are now running at up to 12 months, the % of Motability vehicles concerned and the % of people who lose their appeal is now considered as financially unmanageable, so you will now not be allowed to keep your vehicle for a DLA appeal period.

Clearly a side affect of ESA appeals clogging up the appeals system. Unfortunately these ESA appeals are now having a direct effect on DLA appeals.

    - not any quotable / post able one, I've just had a look on the same site [ Stevegale ] you read regularly roger, and its there also, we both know it takes at least 1 month or more to go from a directive to a confessional !

  • My friend's son was turned down for DLA in May 2010 - he went from HRC and HRM to zero for both, thanks to a wholly inaccurate report from school. My friend had to return the Motability car when the DLA stopped in the May - they were not allowed to keep it any longer, despite going to appeal.

    In February this year, HRC and HRM were awarded and backdated, but the family had already had a hard time without a vehicle and without care payments and CA.

    Yes it is correct that Motability would let you retain the vehicle whilst an appeal/reconsideration were ongoing. However, they will now only let you keep the vehicle for a period of four weeks. Any queries about this should be directed to Motability and not DLA.
  • Hmm well my daughters DLA was reduced to LRC and zero motability from HRC/HRM u[on renewal and we were due to hand the car back on 29th sept.We phoned motability and told them we were initially going for a reconsideration request and they have extended our car lease until march 29th next year.Infact we just got the RSA insurance docs through yesterday showing cover till march.
    We got the reconsideration result through last week and the award was upped to HRC/LRM but have now requested a written statement of reasons then will appeal.Motability told me on fri that the car IS ours till march so no idea why we've been allowed an extension if you say they don't do it anymore?Is it judged on a case by case basis do you think?

    Maybe. It is a matter between yourselves and Motability. The lines to take insofar as DLA are concerned are that Motability will only now let you retain the vehicle for a period of four weeks. As Motability is an independent charity and separate from DLA they may well deal with each case separately.
