A nice email from the Parking Eye Team!

I have just been doing a bit of e-mail tiding up and I stumbled along an unopened e-mail from the Parking Eye team... this is even more bizarre given I have never e-mailed them!!! I think I missed the e-mail originally because it came through as being from [EMAIL="info@parkingeye.co.uk"]info@parkingeye.co.uk[/EMAIL] but it landed on the 22nd September. I then remembered I had e-mailed Paul Comer of Welcome Break some weeks before and he very kindly ignored some nice questions I had from him and passed on my e-mail to his [STRIKE]co-conspirators [/STRIKE] partners at Parking Spy!
How nice of him to break the data protection act and send my e-mail and e-mail address on to Parking Eye without asking my permission!
However, I thought it was worth posting there very [STRIKE]deluded [/STRIKE] nice reply!

We are aware of the very limited and very generalised information made available by such sources as Martin Lewis and of some of the highly unreliable posts on other consumer forums on the subject.
Unfortunately, there is a common misperception that all parking enforcement falls under the either: the various Road Traffic Acts; or Traffic Management Act 2004 and there is a general lack of awareness that private car parks operate under a completely separate and distinct framework from both local council, and police-enforced on-street parking on the highway. This can often cause confusion.
ParkingEye are private car park operators and operate on private land under the British Parking Association Approved Operators Scheme Code of Practice.
Motorists enter into a contract and agree to be bound by the parking terms at a location, defined by the landowners, in return for use of the facility. ParkingEye monitor compliance with the contract via the Automated Number Plate Recognition (ANPR) System and enforce any breaches.
ParkingEye notify the motorist of these terms via clear and ample signage positioned at the entrance and within the controlled parking area. When the motorist enters the car parking facility they accept the parking terms of the landowner by the action of parking their vehicle. The motorist therefore has a contractual obligation to adhere to the parking terms, as the contract creates their licence to use the facility for the defined period either free of charge or subject to paying a pay and display tariff. If the motorist is not given this licence, they will effectively be trespassing on private land. Motorists are also clearly advised via the signage of the costs of breaching the terms and therefore also accept that a Parking Charge will apply if they over stay or otherwise breach the parking terms.
Parking terms are specifically tailored to the habits of genuine customers, and types of permitted parking and exemptions are set depending on the authorised uses of the site. Hence, the systems are bespoke and specifically designed to capture those persons abusing the facilities. As a rule, the parking tariffs set by retail clients where applicable, anticipates that a motorist parking in their customer parking facility will also spend money at the sites retail outlets, so parking can be offered to customers at heavily discounted rate or for free for a limited time. The Parking Charge levied for breach of the parking terms, represents not only the cost of the space in terms of business rates, but also the opportunity cost of the use of that space by a non-customer and the administrative cost of monitoring compliance and collection from motorists breaching the parking terms after the event.
Parking Charges are routinely cancelled where a motorist can show they have made an agreed minimum spend at the retail outlets or where they have legitimately used the facilities and can provide proof of this. With some Welcome Break sites now providing the electric car charging service, Welcome Break have implemented a process to ensure that Parking Charges are not issued to these motorists via the permit system in operation.

Do they really... I you sure you don't mean an arbitrary set of 'rules' that you just make up so you can cheat into them giving you there money?

...and it is this confusion that we exploit to the full to trick people into thinking we have right to take their hard earned moneyn and hence the reason we go to great lengths to make our PCN's look like a real PCN!

Err, no they will not and we have no idea about the civil law of trespass. I wonder how the postman gets all those lovely cheques into the Parking Eye office without signing a contract... maybe they have a sign at the end of the path with the 'contract' the postman enters into when he drops off the post! If he doesn't push the letters all the way through, they charge Royal Mail £100!!!

That is ok then... if only it was the truth... but then your PROFIT making business wouldn't actually make much money and then it wouldn't be worth doing it!

I am somewhat surprised they could string together a letter, although it confirms they haven't got a clue. Strange how they sign their letters the "Parking Eye Team" !!!!!!. We can only assume that no body wants to put their name to that BS!
However its Mr Mark Anfield who deals with Welcome break for Parking eye, Paul Comer always shifts any questions to them. Mind you after the emailI got from Mr Comer I can understand why he does! He has not got a clue!0 -

Is it worth pursuing the breach of DPA with Trading standards, after all they have their EYE (LOL) on Parking Eye in a few areas...0

That is rich coming from a dodgy outfit that put up two illegal websites pretending to be discussion forums about parking. I reported them to Trading Standards as did others on here and the websites were closed down. Parking Eye = liarsStill waiting for Parking Eye to send the court summons! Make my day!0

In 2009 one of the websites was https://www.spacetopark.co.uk, I cannot remember the other one. Both contained spoof forums with the posters claiming that they had CCJs from ParkingEye after taking advice from other forums. Pathetic lies. Both forums also broke Nominet rules as being listed as private.Still waiting for Parking Eye to send the court summons! Make my day!0
