Car accident - not my fault! Why should I have to pay

Hi there,

I'm new to this place, and I also don't have the time to be looking at all the threads so I apologise if this has come up before.

On sunday, my neighbour was reversing out of the drive way, and he hit my car which was parked on the road on the other side. It was the first time I had parked on the road since my car got broken into so for this to happen I was LIVID.
I thought the person who did it drove off and not come forward, then I realised who it was. He probably would have gotten away with it if I hadn't caught him out!!

Anyway, he owned up to it, has given me his insurance details and said to find out how much it will cost and he will decide whether to go through his insurance or not.
I've been told it's going to cost over £1000 but have not got that in writing officially. It's unlikely he will pay out of his own pocket so this is where it gets stressful:

1. If he goes through his insurance, will I have to pay my excess and lose my no claims bonuses? My excess is £400+ and my no claims is 3 years.
2. Is there a way around this, so he has to pay?

3. How do I go about getting this sorted out?

4. Can I get legal help, I have legal cover in my insurance

I'm so upset, I could cry :(

    no you won't. you onlypay excess when you claim on your own insurance for your own repairs.

    the only thing is what damage has been caused, was the estimate from a main dealer also. You will need to inform your insurance company anyway, this may put your premium up for the next 5 years by about £30
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.
