Card Protection - not PPI!

In August 2007 my partner made a payment to his credit card to bring his balance within his agreed limit of £850. I recently checked his statement as his direct debit payment was increasing and discovered his current balance is now over £1100. As he had destroyed the card in 2007 and had made all payments since, I dug out all his statements and found that an annual charge was being applied every September for card protection along with charges for this having put him over his agreed limit.
We have contacted his credit card provider and they have since advised they they will try and refund back the most recent charge for card protection as we had requested this prior to it having applied. We had asked that all charges for this card protection and all resulting charges created by the charges for the card protection be refunded back to the account which would bring the account back to within its limit as my partner never takes out insurance and had no recollection of this policy. We were told that this was not possible and that my partner had opted for it when he applied online for a Barclaycard. It was suggested that my partner increases his payment and when I said we could not afford to do this were offered the option to speak to someone regarding an 'arrangement' on the credit card.
Can anyone offer any advice on reclaiming these charges or are these charges justified? We are going to write to ask for evidence that my partner asked for the insurance but not really sure what else, if anything, we can do. We cannot understand why they allowed the payment protection to be charged to the card but had we tried to use it for anything, would have been declined.
Had we known we had the policy previously we would definitely have cancelled it as the card can't be used, most of the other bits are covered under our home insurance and haven't been able to afford a holiday in years!

Hi there
Maybe a Subject Access Request (SAR) would come in useful in this case.
They have 40 calendar days to comply and send all data held on the account with a one off payment of £10 cheque or postal order.
Below is a template letter (SAR) if you want to go for this, and with it being an online purchase its possible it was already added, but if not required then it had to be unticked (easily missed).
