    A few times...........out of 1696 posts -- not bad huh?

    And usually it's not a case of the advice being wrong, just not applicable to that current op.

    We're all human I guess (except you obviously). Guess your not going to tell me which bid of advice in this post is wrong, I wonder why.
  • Both the Consumer Direct and the Which legal adviser said that as an option I can pay the cancellation fee under protest to protect my credit ratings reserving my rights to recover the money from them later through legal action.
    This would mean that to get the money back I would definitely have to take court action.

    If you haven't taken out a credit agreement (ie purchased on finance), the only way it can affect your credit report is by them obtaining a county court judgement (CCJ) against you -- its is reported to the credit reference agencies if unapid after 28 or 30 days (can't remember which).

    If you have to take them to court, it will be you paying the initial outlay of court fee + hearing fee if it gets to that stage + any costs involved in enforcement if applicable. Although an option, not one I personally would choose.

    The judge can award fees, yes.
