Any advice on car sale gone wrong

Options
Hi all,
I recently ‘sold’ my car to a local guy on the basis he would pay me each week with instalments until the total price of the car was reached. He paid me a £100 deposit initially and took the car. Since then he has not paid me despite me asking him or given me the car back. He keeps making excuses that he has lost his job and can’t afford.

I did ask him to sign a what car sold car receipt which detailed the instalments and had both our signatures on it. Is there anything I can do with this? Can I take him to court and will I have a legal leg to stand on?

Please help! I feel like such an idiot to have trusted someone on their word. :(

Small Claims Court, you need to have beyond resonable proof to go down this route and depending on the actual amount owed can be expensive and also if he claims to have no money you may get little or nothing back.
  • What's happened to your previous post where you asked exactly the same thing?

If your genuine and you don't want to do it yourself, either give the spare key, that I'm sure you will have had the foresight to keep, or use a local garage with a recovery wagon to bring your car home. Police are never interested in this type of stuff so take positive action, get your car back and get a new V5c.

I made the silly mistake of doing this once with a work colleague must be 20 years ago. I ended up going round at 3am and taking it with a spare set of keys. Plod duly turned up the following morning, I told them what had gone on and they just went away. The guy I sold it to ended up with a 10 year prison sentence a few weeks ago for fraud...

Yeah, it is silly, I have been there, cost me a £3k car. But I learnt a good lesson. While you can, get it back. If you have the spare key, just take it back, otherwise, man up and take the keys off him. Don't be take advantage of. You will only look back for the next 20 years and wish you had done it. I did nothing and regret it. My wife brings it up at any opportunity.(in jest now though)

Do you still have the v5 in your name etc ?

As above. Stop bending over and dropping your trousers for this chap. He's having a proper laugh at your expense.

Take the car back yourself. I trust you never signed over the V5 etc to him? If so, let me know if you are selling your house any time soon.....

I posted exactly the same reply to the 1st posting between laughing and falling over, can't be bothered to do it again.;)

Why oh why don't folks ask the "should I ......"question before they embark on ludicrous payment methods???
I like the thanks button, but ,please, an I agree button.

Will the grammar and spelling police respect I do make grammatical errors, and have carp spelling, no need to remind me.;)

Always expect the unexpected:eek:and then you won't be dissapointed
