    I passed the m62 guys house on Saturday going to York races..It was very very spooky with fog everywhere and when i see that sign that says saddleworth moor my blood runs cold every time.
    It is nice to see the value of your house going up'' Why ?
    Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
    If you are planning to upsize the new house will cost more.
    If you are planning to downsize your new house will cost more than it should
    If you are trying to buy your first house its almost impossible.
  • Firstly I'm not sure about a Local Authority CPO but for major schemes promoted by the Highways Agency legally the CPO is absolutely restricted to the area of land required to build / improve the highway. Over the years I have been involved in a number instances where buying a small area of land would have made things a lot better but as they were not essential for building the highway they could not be included in the CPO. There are cases e.g. with farms / smallholdings where the area of land left is not economic and the Highways Agency has to buy the additional area as well. When these additional areas are required in cases like yours they generally have to be bought by negotiation. I would suggest finding a good land agent who could also progress your blight compensation claim at the same time.

    Have you just received the CPO or has it been made (i.e. it has already been advertised and the objection period has ended)? If you are at the start of the process then you could write now to say that you wish to object and further details will follow - this will get you on the register of objectors so you will be kept informed as things progress.
  • It is my understanding that the Council should be in talks with the OP. Generally, the CPO process takes a long time, lots of meetings with each affected landowners and tenants. Ultimately, a Public Inquiry will be required to determine the validity of the case and the Inspector to make recommendations to the Secretary of State to publish the Order. The Council should cover the reasonable costs of the OP employing a Land Agent to advise them.

    Below is from the O/H not me.

    Councils have powers to do all sorts of things, amongst them building roads. If building the road means that they need to do others things such as providing an access then they have powers to do that as well.

    Why bother argueing about the need? Negotiate the best deal that is possible. To do that you need professional advice which you will not pay for as the council has to pay it. Just make sure that the council will be responsible before you incur any costs.
