Really annoyed with Ebay...

Hi

I seem to have lost out here, no thanks to Ebay, and wonder if someone can advise me?

I bought a professional tutorial DVD in good faith for approx £48 (from Israel) which was obviously a fake once it arrived. I complained to the seller who said he would refund once I returned the item. I posted it, with proof of postage, around one month ago, but I didn't have it tracked (thought this wasn't possible if it was going abroad but think I was probably wrong on this). Anyway, no refund came so I opened a case with ebay, who turned me down because I hadn't tracked it. I had argued that the item was a fake so, to be honest, I didn't see why I even had to return it for him to sell to someone else. (At the time of purchase he had 100% feedback from 23 deals but has since received negatives from two other people).

Is there anyway I can still get my money back as seller now not replying to me, obviously very happy with ebay! Paypal won't help because I had "already opened a case with ebay". Still rather confused as to how I have managed to lose my money......! (Just checked and seller no longer registered with ebay, at least under that name.)

    Your only hope is to keep trying with Ebay that you were sold a fake, esp if Ebay told you to return it. As it stands right now you have no item and therefore no proof it was a fake and nothing to show that that is what you posted. You could also try Royal Mail and see what they say but it is all clutching at straws with little chance of you getting anything back at this stage.

    Unfortunately I returned it to the seller before I opened the case with ebay, hence I didn't follow their conditions re tracking of item. I was going to try Royal Mail but, as you say, don't hold out much hope there. Really annoyed with myself as well!

    You have answered your own question. So this is hardly their fault!

    You could try to open a case in eBay for fake goods and hope they tell you to destroy them.

    If you have a proof of posting then you can make a claim with RM for up to £46 which is all you insured them for.

    All you can do now is file with RM that the item was never received, but I hear they started sending out forms to the recipient (Israel) that they have to fill out to say they didn't receive the item? I dont know, but it's worth a shot.

    HAve you gotten in touch with the seller? I have problems with ebay too... I don't trust it. I chose Amazon any day!

    As the seller is selling counterfeit goods, they probably aren't going to be that helpful to someone who's caught them out.

    Claim from RM, and leave a factual neg for the seller stating that the item was fake.
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)
