Does Jersey and UK have a reciprocal agreement?

Hi All

I have just received a summons from a company in Jersey (channel islands) and I am meant to be in court 28th October in Jersey. I have been living back in the UK for the last 2 years and I am now wondering if Jersey and the UK have a reciprocal agreement? and if a judgement that was taken out in Jersey could effect me here in the UK? Is there any information anyone can give me on all of this? I am also wondering what would happen if I was unable to get over to Jersey for it?

    Yes. See The Reciprocal Enforcement of Foreign Judgments (Jersey) Order 1973 - http://www.legislation.gov.uk/uksi/1973/612/made

    Generally speaking the Foreign Judgments (Reciprocal Enforcement) Act 1933 applies where Commonwealth countries are concerned, and the Brussels Convention applies where European states are concerned

    Why dont you settle your debt in Jersey then you wont need to worry about it?
  • Hi I lived in Jersey for 3 years and I cant afford to settle it as its for £25000... I was thinking of going bankrupt but im not sure if it will effect the Jersey debt as they do not accept individuals going bankrupt over there!! Now im not sure what to do as they want me to go over for it but there is no way I can pay anything and im now worried about my car... I cant give that up as without my car I will not be able to work!! I do not own anything else either!!

    Why cant you go bankrupt in Jersey anyway?

    According to this source - http://www.bankruptcy-insolvency.co.uk/bankruptcy/bankruptcy-jersey-law.php - you can go bankrupt in Jersey. They call it d!sastre though.

    I will look into this a bit more as when I lived in Jersey I was told that an individual could not go bankrupt unless it is part of a business but I will have another look and see if I can.

    If you go en desastre in Jersey then it is likely to affect your credit record. Information recorded by credit reference agencies is likely to include judgements from the channel islands.

    Also banks in Jersey will record the info so if you try for a loan etc in the UK this will likely come up as part of credit checks.

    Would be best to face up to things and come up with a payment plan with your creditors to stave off a judgement.
