Life Insurance- No Beneficiary Named

My dad died recently and although there was a small amount of life insurance, there was no named beneficiary. Does this need to go to my mum or could it go to me or my brother, with my mum's agreement? We are not dependant children.

It gets paid into his estate unless the policy was jointly owned or owned by someone else. The estate will follow the Will, if there is one or the rules of intestacy if there is. Thanks, he didn't have a will so intestacy will apply. We are in Scotland so I have the relevant legislation.
