Car Insurance Companies

My daughter and I was involved in an accident in January/February this year when her ex partner ran us off the road. he was subsequently arrested and jailed, then found guilty and given a 1 year driving ban with a 1 year probation period with special bail conditions. My daughter has only just got her car insurance renewal quote in at the weekend and her insurance company are quoting her £4,879 for her years insurance due to this accident which was a no fault claim and they have confirmed this but as his insurance company is still not accepting liability her insurance company is basically penalising my daughter. She has never had a claim before this. She is a single parent with two children, she needs her car to get them to school and nursery and then herself to work, becuase of this she has had to declare her car off the road until she can sort something out witht he insurance company. I would like to know how his insurance company can get away with not accepting liability when their client was clearly found guilty and sentenced with a driving ban and a years probation. Can someone please answer this for me.

    If your daughter claimed off her own insurance, then they won't reinstate her NCD till they are fully reimbursed from the third party. Keep chasing them to sort this out for you.

    Next time she is involved in a claim which is not her fault she should first try and see if she can avoid claiming off her own insurance and going direct to the third party insurer for her damages (or use a claim handler to do it for her).
  • That is fine in hindsight, this is the first accident she has ever been involved in as she has only been driving 2 years. If we had known that at the time we would have gone down this route. But I still don't understand why his insurance company can get away with not paying out on the claim and not accepting liability when their client was cleary arrested and charged with the crime and found guilty and sentenced accordingly. ????? :mad:

    They won't get away with it, but these things do take time to resolve (too long IMO).
    What has she been doing to chase them since Jan/Feb.
    Has she made a formal complaint? has she chased them and asked for updates?
    If the other insurer aren't playing ball then her insurer needs to threaten legal action. Clearly they'd rather not do this so things take time.
    She needs to be assertive and do whatever is in her power to speed things up.
    Two things spring to mind. One is to actually hassle them on the phone and the second is a formal complaint.
    I've found thtat often complaints go to a completely different department and often you get a completly different (much improved) service.
    I knwo it shoudlnt be her responsibility but if she just lets them drag their feet then that's exactly what they will do.

    You need to ask this question to your insurer (eg. it may be that despite the conviction, full liability is being disputed - the conviction will be for a criminal offence, and won't be a court decision on liability!)

    If he is in jail they probably have not been able to contact him for his side of the story, in addition he is probably deliberatly avoiding helping his insurance company.

    This will mean they will have been trying to contact him to confirm his side of the story and will then try and obtain a police report, the police can literally take months to supply these
